Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan and Existing Block Plan - Dwg No. MH01 Proposed Outbuilding and Block Plan – Dwg No. MH02B Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
A bat box shall be installed within the land ownership of the site (e.g. Ibstock enclosed bat box, Habibat bat box, Schwegler Wall-mounted Bat Shelter 2FE, Schwegler 2F Bat Box). The box should be installed at least 4m above ground-level, and not placed above windows. The roosting feature shall be installed before the first use of any part of the development. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the measures set out in the Root Protection Area Information document for 2 Madge Hill submitted with this application. In particular:- - Heras fence panels 2.4 metres high to provide temporary fence during the whole of the construction period, and to prevent any persons, machine or plant entering the protected area. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
The outbuilding development hereby permitted shall not be occupied at any time other than for purposes incidental/ancillary to the residential use of the dwelling known as 2 Madge Hill. The development shall not be used as an independent self-contained dwelling separate from the dwelling known as 2 Madge Hilland, and shall not be used for any non-incidental trade, business or commercial enterprise whatsoever. . Reason: To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan and as a separate dwelling house in this location would not represent sustainable development and be contrary to the development location strategy set out in policy SWDP2 of the South Worcestershire Development Plan.

In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
