Condition Details / Information Notes
The proposed development by reason of its location would conflict with the aims of the South Worcestershire Development Plan and the NPPF to reduce reliance on the private car as a means of transport. The proposal would fail to minimise the demand for travel. Moseley road is narrow, there is no footpath and the area is without street lighting, as such it is not conducive to walking and cycling particularly, during periods of inclement weather. The proposal would be contrary to policy requirements set out in NPPF 105, 110 and 112 and the SWDP 4 and 21 in that the site is not positioned in a sustainable location, nor does it offer a genuine sustainable travel choice.
The proposed development by reason of its location in between two sections of built development fronting the lane would exacerbate the linear form of development and have the effect of urbanizing Moseley Lane. This would harm the character and appearance of the countryside. The proposal is therefore contrary to paragraphs 135 of the National Planning Policy Framework and Policies SWDP 2, 21 and 25 of the South Worcestershire Development Plan 2016.
Notwithstanding the general harm to character and appearance of the area of any development on the site it is noted that the existing development either side is at a higher density, i.e. dwellings immediately adjacent to the site are either semi-detached or smaller closely clustered cottages. The amount of development proposed would not represent an effective use of land contrary to the Government’s objective to boost the supply of housing. The proposal is therefore contrary to policy SWDP 13 (Housing Density) of the South Worcestershire Development Plan and the National Planning Policy Framework (Dec 2023) and in particular paragraphs 128, 129 and 60.
In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant that would overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reason set out in the decision notice.
