Condition Details / Information Notes
The cumulative floor space of the existing building changing use to two larger dwellinghouses is approximately 697 square metres, which exceeds the figure of 465 square metres included within Paragraph Q.1(b)(i)(bb). As a result of this, the proposal fails to comply with paragraph Q.1(b)(i)(bb) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and is therefore not permitted development.
The application proposes the addition of a significant amount of new material, namely by way of the installation of natural timber cladding and corrugated cladding, and the installation of a significant amount of glazing. Furthermore, a number of larger apertures, which would facilitate the addition of new windows and doors, are proposed. Noting the conclusions made within the structural report, it is considered that the proposed building operations would go beyond those reasonably necessary to convert the building. As such, it is considered that the proposal fails to comply with paragraph Q.1(I)(i) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and is not permitted development.
The application proposes the removal of a significant amount of the application building’s existing fabric through the removal of approximately 238 square metres of the existing building, which includes the central section of the building and the existing single-storey lean-to along the building’s eastern elevation, and the creation of a number of large apertures to facilitate the addition of new windows and doors. Due to its scale, it is considered that the proposed demolition would go beyond partial demolition to the extent reasonably necessary to carry out building operations allowed by paragraph Q.1(i)(i). As such, it is considered that the proposal fails to comply with paragraph Q.1(I)(ii) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and is not permitted development.
No information has been submitted with the application which demonstrates that there would be sufficient ‘vehicle to vehicle’ and ‘vehicle to pedestrian’ visibility when exiting the application site via its existing access. Due to the fact that the proposal would result in an increase in the intensity of the use of this existing access, the application site is located near to a bend in the road and the point at which the highway speed limit changes to the national speed limit, and as there is vegetation located immediately to the west of the existing site access, it is considered that in the absence of this information it is not possible to confirm that the proposal would not have a detrimental impact on highway and pedestrian safety. The proposal is therefore considered to be unacceptable and contrary to Policy SWDP 4 of the South Worcestershire Development Plan (2016), Worcestershire County Council Streetscapes Design Guide (2022) and Chapter 9 of the National Planning Policy Framework.
The proposed building operations would adversely alter the external appearance of the application property. Not only would the proposed demolition work result in the creation of two detached buildings, but the resultant dwellings would be out of character with the surrounding buildings by reason of the proposed glazing and cladding. In contrast, surrounding buildings, including the two grade II listed buildings located to the north-east and east, are predominantly brick built and possess a traditional appearance. As such, it is considered that the proposed dwellinghouses would represent incongruous and obtrusive features within the local built environment and therefore have a detrimental impact on the character, appearance and visual amenity of the local area, contrary to Policy SWDP 21 of the South Worcestershire Development Plan (2016), Policies LB/D/1 and LB/E/6 of the Leigh and Bransford Neighbourhood Plan (2022) and Chapter 12 of the National Planning Policy Framework.
