| Evidence in the form of a structural survey, which clearly demonstrates that the existing building is capable of being converted for its re-use as a dwelling without the need for substantial re-construction, has not been submitted in support of the application. As a result of this, the application fails to demonstrate compliance with Policies LB/H/2 and LB/H/4 of the Leigh and Bransford Neighbourhood Plan (2022), Policy SWDP2(C) of the South Worcestershire Development Plan and paragraph 84 of the National Planning Policy Framework and is unacceptable in principle. |
| In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan and Supplementary Planning Documents, and have provided pre-application advice to the applicant, in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the principal of the proposal is considered contrary to our statutory policies and negotiation would not overcome that reason for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice. |
