The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 21/010247/FUL (27th January 2022)
Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended). |
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents –Location Plan, Site Plan Site/2, Parking Layout 20/1- PAR, Floor Plans and Elevations 19/1- 4a,5a,6a,2,3,7 & 1 & 242000/X/C/04.
Reason: To define the permission. |
The materials to be used in the construction of the external surfaces of the extension hereby permitted shall be as approved by details:
1. External wall up to dpc - red engineering facing brick
2. External wall above dpc - horizontal softwood shiplap boarding with stain
3. Windows - upvc in light oak
4. Plain clay red roof tiles
Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.

There shall be no more than 10 residents at the facility hereby approved. Use of the facility for educational purposes shall be limited to the 10 residents and there shall be no day students.
Reason: In order to control the consequent number of vehicle movements in the interests of sustainability and SWDP 4 South Worcestershire Development Plan. |
Before the first use of the development hereby permitted a scheme of landscaping to cover the gaps along the western roadside boundary shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.

The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Baseline Ecological Survey
& Bat Survey report carried out by Elizabeth Mckay in August 2021 and submitted with this application. In particular:-
- Compliance with the method statement set out in section 6 of the report
- Prior to occupation of the extension hereby approved Biodiversity Enhancements consisting of the planting of a native hedgerow or native shrubs for the benefit of wildlife shall be submitted and approved in writing by the Local Planning Authority. Suggested species which would be suitable to include; Hazel, Hawthorn, Holly, Blackthorn and Field Maple. The location and detail of the planting should be included on the submitted plan.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.

Within 3 calendar months of completion of the development hereby permitted the portacabins as shown on the approved plan ref. 24200 X C 04 shall be permanently removed from the site.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
The portacabins shall be used for administrative functions only and shall not be used for teaching space
Reason: In the interests of residential amenity in accordance with policy SWDP 21 of the South Worcestershire Development Plan.

The parking for site operatives and visitors shall be provided within the application site in accordance with details approved by the Local Planning Authority and such provision shall be retained and kept available during construction of the development.
Reason - To prevent indiscriminate parking in the interests of highway safety.

Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant. |
