Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans and documents VEC483.01 Location Plan, VEC483.03, Meyer Burger Black Specification Details. Reason: To define the permission.
The stand alone Solar Tracker devices hereby permitted shall be installed to be black in colour of a matt finish material including all framework and invisible wires and no other type substituted. Reason - To preserve the open character of the countryside in accordance with Policies SWDP21 and SWDP25 and the setting of the listed building in accordance with Policies SWDP6 and SWDP24 of the South Worcestershire Development Plan (February 2016).
If the stand alone Solar Trackers hereby permitted are no longer required for the purposes of energy production, they shall be dismantled and all materials removed from the site, including the sun arrays and their supporting stands and any other associated infrastructure/development within 4 months from the date of cessation of the use. Reason - To preserve the open character of the countryside in accordance with Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan (February 2016).
Within the first planting season following the installation of the solar trackers devices hereby approved the additional hedgerow planting as specified on the approved plan VLC483. 03 shall be implemented. The hedgerow shall comprise of the species mix as specified on the approved plan and all planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. If any part of the hedgerow dies, is removed or become seriously damaged or diseased it shall be replaced in the next planting season with others of similar size and species. Reason - To preserve the open character of the countryside in accordance with Policies SWDP21 and SWDP25 and the setting of the listed building in accordance with Policies SWDP6 and SWDP24 of the South Worcestershire Development Plan (February 2016).
Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible. In addition all contractors shall be made aware that If excavations for cable channels are dug and left open overnight, a temporary escape ramp shall be installed along the inside of the trench for wildlife and hedgehogs in particular. All trenches shall be checked each morning before work commences and any trapped creatures lifted to a place of safety.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
