Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents –Location Plan SL-01 Rev A, Block plans BP-01 Rev A & BP- 02 Rev 2, Floorplan and Elevation details as shown in submitted 'Wildhuts Brochure'. Reason: To define the permission.
The holiday let unit/visitor accommodation hereby approved shall be occupied for holiday purposes only and shall not be occupied as a person or persons’ sole, or main place of residence. Reason: The proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with policy SWDP2 and SWDP36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP36 of the South Worcestershire Development Plan .
The owners/operators of the holiday let unit/visitor accommodation hereby approved shall maintain an up-to-date register of the names of all owners/occupiers of the units/accommodation. This register shall be made available within 1 calendar month of a written request by the Local Planning Authority. Reason: The proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed units/accommodation are only acceptable as a holiday let/ tourism development in accordance with policy SWDP36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP36 of the South Worcestershire Development Plan .
The shepherds huts shall comply with the definition of a caravan set down in Section 29(1) of the Caravan Sites and Control of Development Act 1960, Section 13(1) of the Caravan Sites Act 1968 and the Social Landlords (Permissible Additional Purposes) (England) Order 2006 (Definition of Caravan) (Amendment)(England) Order 2006. Reason: To ensure the development does not have an adverse impact on the character and amenity of the area in accordance with policies SWDP21 and SWDP25 and to ensure that the accommodation are not a permanent structures in the interests of the amenities of the area and to comply with Policies SWDP2 and SWDP36 of the South Worcestershire Development Plan.
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The Development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided as shown on drawing BP-02 Rev A (Block Plan 02). Reason: In the interests of highway safety and to ensure conformity with the submitted details and in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
