Malvern Hills District Council hereby gives notice that PRIOR APPROVAL IS REQUIRED FOR THE SITING, DESIGN AND EXTERNAL APPEARANCE of the open sided machinery store and HAS BEEN REFUSED for the following reason(s):- 1. The increased footprint of the proposed barn would be more prominent within the setting of the heritage asset. From a distance the barn would stand within the complex of the farmstead/business units but it would be more prominent in the short distance views and experience, especially as the PROW passes directly in front of the location. It is considered that the barn would not conserve or enhance the listed building and would cause less than substantial harm to its setting (low-moderate range). Consequently, due to the appearance, scale and siting of the building it would fail to respect and protect the significance of the heritage assets contrary to Policies SWDP6 and 24 of the South Worcestershire Development Plan (February 2016) and section 16 of the Framework. 2. The poor quality materials and design, in conjunction with the length of the building proposed, and it’s siting, in extremely close proximity to the public right of way, would result in a prominent and unsympathetic feature which would have a significant and harmful impact on the character of the area, resulting in a harmful encroachment into the open countryside that would be to the detriment of the landscape character, contrary to Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan. 3. The application has been made with the justification that the building is required for unspecified security reasons and to release the existing agricultural unit to be converted for B8 use as approved. Furthermore, in visiting the site the existing Dutch barn was in use for equestrian purposes and officers are not convinced that the building would be used solely for agricultural purposes. Overall, it is not considered that the proposed new agricultural building is reasonably required or necessary for the purposes of agriculture and therefore the proposal would not be permitted development by virtue of Part 6. NOTES TO APPLICANT This decision has been taken having regard to drawing no/s: 1449-03 Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
