The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans.

Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the preliminary ecological appraisal report carried out by Wilder Ecology dated 12 October 2021 and submitted with this application. In particular:
- All persons involved in the dismantling works to the old cottage, outbuilding & existing single storey extensions on the house as well as building the new extensions shall receive a detailed 'Toolbox Talk' on Nesting birds, Bats & Great Crested Newts from a suitably qualified ecologist
- Before any dismantling works begin to the old cottage building or the outbuilding, a pre-commencement check to see if any birds have begun nesting or that there is any evidence of use by bats. All roof dismantling works to the old cottage will be overseen by a suitably qualified ecologist.
- All vegetation on the old cottage building & outbuilding & on the site that requires removal will be carried outside of the main birds nesting season March/April to August. If required by the LPA a Reasonable Avoidance Method statement will be drawn up before any works begin & followed by all contractors on site. If any bats or GCN are found all works will cease until Natural England has been contacted and way forward agreed which may include a license application to permit the works to continue.
- No new external lighting are planned on the walls of the replacement buildings (including extensions) that could cause additional light spill into the surrounding area and the existing flood lights will ideally be replaced with downlighters that will direct light away from the boundary habitats & wider surrounding countryside.
- As an enhancement that will provide a real biodiversity gain a green roof will be provided on the proposed home office. For maximum biodiversity gain the roof should be comprised of a wildflower meadow mix or Hay base system similar to the organic hay base roofs as this will increased the nectar sources for wildlife.
- Insect houses should be erected on the side wall of the proposed home office and annex.
- The ornamental pond should also be restored & extended to allow water to be retained all year round & wildlife to access the pond.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.

Within one month of the commencement of construction works on the development hereby permitted, details of bat roosting features shall be submitted to and approved in writing by the Local Planning Authority. The details to be submitted shall include an implementation timetable and show the locations of the proposed features. The features shall be provided in accordance with the approved details and in accordance with the approved timetable and remain thereafter.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Before the first occupation of the building(s) hereby permitted the first floor windows proposed on the north side of the two storey extension shall be fitted with Pilkington Level 4 obscured glazing or equivalent and shall be permanently retained in that condition thereafter.
Reason: To protect the amenities of adjoining properties from unacceptable overlooking and loss of privacy in accordance with policy SWDP21 of the South Worcestershire Development Plan. |
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Summerfield and shall not be used as an independent self contained dwelling separate from the dwelling known as Summerfield.
Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan. |
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant. |
Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible.
However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts. |
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
