Condition Details / Information Notes
The recommendations in the submitted structural appraisal carried out by RCH Structural Engineers raises serious doubt on the validity of the appeal reference APP/J1860/W/20/3263591 as dismissed on the 14 May 2021 as the planning inspector was not made aware of these recommendations and the contradictory statements within this structural appraisal. The structural appraisal states that the existing buildings could be converted without the requirement for structural alterations or strengthening. However the appraisal then recommends that any new structural requirements to support additional internal structure are to be built of new structural elements 'internal load bearing walls' and appropriate foundations provided. No additional loading to be applied to the existing structure except the change of external cladding sheets. As part of the dismissed appeal reference APP/J1860/W/20/3263591 the Planning Inspector raised doubt that the existing buildings were capable of conversion and the foundations could take the weight of the glazing panels and at present it cannot be ascertained from the structural appraisal if the buildings would still be capable of conversion without extensive new building works and if the glazing panels could actually be applied to the existing structures. as such the condition and appearance of the buildings still raises serious doubt that they could be easily converted without an extensive overhaul and the applicant has failed to submit sufficient information to explain the conclusions of the submitted structural appraisal or demonstrate the extent of the new load bearing internal walls or explain what the 'additional internal structure' would comprise of and that the amount of new elements that would need to be added to the existing buildings would not go beyond reasonably necessary and would require extensive building works to actually create new dwellings within the envelope of the existing buildings. As such the existing buildings are not capable of conversion and do not have the permitted development rights under Paragraph 105 Reference ID: 13-105-20180222 and the amount of new building works required would beyond the remit of what would be reasonably necessary for the proposed conversion and the proposal does not comply with Class Q Part Q1 (i) (i) & (ii) of the Town and Country Planning (General Permitted Development Order) 2015 (as amended).
The applicant should be aware that the application was determined on the following refused drawings - Location Plan Scale 1:2500, 3836-02D.
