Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 21/02/01 - Proposed Block and Location Plan 21/02/02 - Proposed Plans and Elevations. Reason: To define the permission.
No building operations hereby permitted shall commence until details of the cladding and roofing materials (including details of colour/stain) to be used in the construction of the external surfaces of the chalet hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved detail. Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
No development shall take place until a trial pit and percolation test has been carried out in accordance with BRE Digest 365, or such other guidance as may be agreed in writing by the Local Planning Authority. The results of the test shall be submitted to and agreed in writing by the Local Planning Authority and the agreed recommendations shall be implemented in full prior to the development first being brought into use. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include: (i) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (ii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iii) a written specification outlining cultivation and other operations associated with plant and grass establishment. (iv) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Before the first use/occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment, including any new access gates, to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use/occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details. Reason: To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan..
The Development hereby approved shall not be occupied until an area has been laid out within the curtilage of the dwelling for the parking of 1 vehicle in accordance with the approved plan. This area shall thereafter be retained for the purpose of parking a vehicle only. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until the proposed access gates have been set back 5 metres from the adjoining carriageway edge, and made to open inwards only. Reason: In the interests of highway safety in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan.
The holiday let unit/visitor accommodation hereby approved shall be occupied for holiday purposes only and shall not be occupied as a person or persons’ sole, or main place of residence. Reason: The proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with policy SWDP12 and SWDP36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP12 of the South Worcestershire Development Plan .
The owners/operators of the holiday let unit/visitor accommodation hereby approved shall maintain an up-to-date register of the names of all owners/occupiers of the unit/accommodation. This register shall be made available within 1 calendar month of a written request by the Local Planning Authority. Reason: The proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with policy SWDP12 and SWDP36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP12 of the South Worcestershire Development Plan .
The holiday accommodation use hereby permitted shall be restricted to the stationing of no more than 1 chalet or caravan. The chalet to be sited on the land shall comply with the definition of a caravan set down in Section 29(1) of the Caravan Sites and Control of Development Act 1960, Section 13(1) of the Caravan Sites Act 1968 and the Social Landlords (Permissible Additional Purposes) (England) Order 2006 (Definition of Caravan) (Amendment)(England) Order 2006. Reason: To ensure the development is not a permanent structure in the interests of the character and amenity of the area in accordance with policies SWDP21 and SWDP25 and because the proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where development is strictly controlled. The proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with policy SWDP12 and SWDP36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2, SWDP12 and SWDP36 of the South Worcestershire Development Plan .
Before the first use/occupation of the development hereby permitted an ecological enhancement scheme shall be submitted to and approved in writing by the local planning authority. The scheme shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement and the foul drainage details provided within the application forms shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system and foul drainage system is provided to serve the development in accordance with policy SWDP29 and SWDP30 of the South Worcestershire Development Plan 2016.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
Before the first use/occupation of the development hereby permitted details of a precise specification of the proposed materials for the hard landscaping of the site (including roads, paths, parking areas and other hard surfaces) shall be submitted to and approved in writing by the local planning authority. The hard landscaping of the site shall be completed before the first use/occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details. Reason: To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk or by phone on 01905 751651. The applicant is solely responsible for all costs associated with construction of the access.
