Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: DY130TZ/ER/GL - Location January 2021, DY130TZ/ER/GL - Block Plan 2020, DY130TZ/ER/DL - Hedgerow Planting June 2021 V2, 3519/1, 3519/2, 3519/3, 3519/4. Reason: To define the permission.
The use of the all weather arena (manège) hereby permitted shall be limited solely to the private keeping and exercising of horses and shall not be used for any commercial or public equestrian events, enterprise or business whatsoever. Reason: The Local Planning Authority would wish to consider the implications of a commercial or other more intensive use having regard to residential amenity in accordance with Policies SWDP21 and SWDP31 of the South Worcestershire Development Plan (February 2016).
No lighting or floodlighting shall be erected or installed on the land around the perimeters of the all weather arena (manège) and buildings hereby approved. Reason: In order to protect the amenities of this rural area in accordance with Policies SWDP21 and SWDP31 of the South Worcestershire Development Plan (February 2016) and protected species in accordance with Policy SWDP22 of the South Worcestershire Development Plan (February 2016).
Before the first use of the stable buildings hereby approved, a plan showing the position of any manure storage area and details of frequency of manure collection arrangements shall be submitted to the local planning authority for approval in writing. No stable waste shall be stored under the crown spread of any tree and there shall be no burning of stable waste on site. The approved position of the manure storage area shall remain in perpetuity. Reason: In the interests of residential amenity and in order to avoid pollution in accordance with Policies SWDP21, SWDP22 and Policy SWDP31 of the south Worcestershire Development Plan ((February 2016).
Within the first planting season before the first use of the buildings and all weather arena (manege) hereby approved the additional hedgerow planting as specified on the approved plan DY130TXZ/ER/DL Hedgerow Planting June 2021 V2, shall be implemented and shall thereafter be retained in that form, notwithstanding the provisions of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) Order 2015, as amended, (or any Order revoking and re-enacting that Order with or without modification). All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. If any part of the hedgerow, dies, is removed or become seriously damaged or diseased it shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and the setting of nearby heritage assets in accordance with policies SWDP6, SWDP24 SWDP25 of South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal report carried out by Worcestershire Wildlife Consultancy dated February 2021 and submitted with this application. In particular:- - all removal and/or management of suitable bird nesting habitat shall be undertaken outside of the main nesting season and where this is not possible, a suitably qualified ecologist must be engaged to check for nesting birds prior to any works taking place. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
