Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 2023/P/01 Location plan and proposed block plan 2023/P/02 Rev. A Proposed plans and elevations Conservation Type Rooflight details (55 x 98cm finished in matt black) - Velux GGL CK04 3570H Water Management Statement Reason: To define the permission.
Prior to its/their installation as part of the development hereby approved, details of all new external joinery details (elevational drawings at a minimum scale of 1:20 and vertical sectional drawings at minimum scale of 1:2) along with architectural details of the proposed external finishes and position in wall reveal shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include the painted timber balcony structure. The development shall be carried out using the joinery as approved. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with Policies SWDP 6, 21 and 24 of the South Worcestershire Development Plan.
Any removal of roof coverings associated with the new or replacement rooflights hereby permitted shall be carried out carefully by hand. If bats or any sign of bats, such as an accumulation of droppings, are encountered at any stage of work, work shall cease immediately and advice sought from Natural England or an appropriately licenced bat ecologist on how to proceed lawfully. All contractors working on site shall be made aware of the potential for roosting bats and provided with the contact details of an appropriately qualified ecological consultant. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with Policy SWDP 22 of the South Worcestershire Development Plan.
Within three calendar months of the commencement of construction works on the development hereby permitted, details of type and location of a bird nesting box and a bat roosting box shall be submitted to and approved in writing by the Local Planning Authority. The approved features shall be provided in accordance with the approved details prior to the first use/occupation of the development hereby approved. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with Policy SWDP 22 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the details set out in the approved Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that appropriate drainage and water efficiency measures are provided to serve the development in accordance with Policies SWDP 29 and 30 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information and amendments to the proposed development following receipt of the application, as well as considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the application.
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017 (as amended), the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost.
