The application as submitted is deficient in terms of submitted information including the lack of a Heritage Statement, the lack of a tree survey and no information regarding the location of the manure heap. For these reasons the application as submitted is contrary to policies SWDP6, SWDP22, SWDP24 and SWDP31 of the South Worcestershire Development Plan as well as the requirements of the national planning policy framework. |
The stable block is of no architectural, historic or aesthetic merit and represents poor quality design and use of materials. Furthermore, the siting of the stable block does not respect the openness of the parkland. This is particularly the case as it is on the field-side of the access road and therefore separated from the wider complex of Astley Hall and its surrounding buildings. In addition, the change of use of the land has resulted in the extensive subdivision of fields for horses and it is considered that this, and any future additional subdivision, results in visual harm due to the temporary fencing, the small scale of the paddocks, the need for water troughs and other paraphernalia, which would not be sympathetic to the parkland character and therefore the setting of the heritage assets. The development is therefore contrary to policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan. |
The change of use of the land has involved the subdivision of the field which negatively impacts on the open nature of the site and has introduced visual clutter into the parkland landscape associated with Astley Hall. The stables prevent views from the driveway looking south-east, reducing openness, and visually detracting from and an unwelcome addition to the parkland landscape. The location of the stables and associated use of the land is therefore considered to have a detrimental impact on the landscape character, contrary to Policy SWDP21 and SWDP25 of the South Worcestershire Development Plan. |
The large oak tree on the site has not been protected from grazing damage, so it has begun to occur. In addition, no tree survey has been submitted to demonstrate that the stables have not contravened the root protection area of this large tree. Trees and hedgerow were removed to facilitate the development. Overall it is considered that the development has had and is having a detrimental impact on trees and no appropriate survey or mitigation has been provided as part of the application and therefore it is contrary to policy SWDP 22 of the Development Plan. |
Due to the small scale of the site and its proximity to residential dwellings, it is not considered that manure storage can be managed in a way which would avoid adverse impacts to neighbouring properties from odour and vermin, contrary to Policies SWDP21 and SWDP31. |
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; -considering proposed landscaping and amendments to the scheme - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
