Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: 542/001 Rev A Existing Location & Site Plan 542/104 Rev E Proposed Elevations -1 542/105 Rev E Proposed Elevations – 2 542/103 Rev E Proposed G/F Plan Reason: To define the permission.
Prior to first use of the development hereby permitted details to include the type and location of any biodiversity enhancement measures to include bat and bird boxes shall be submitted for approval to the Local Planning Authority. The agreed measures shall be installed prior to use of the development. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Details (including the location, type and design) of any new external lighting must be submitted to and approved in writing by the local planning authority. Any external lighting must be in strict accordance with the advice provided in section 8, Appendix 2 of the bat report. All external lighting shall be installed in accordance with the approved specifications, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 (as amended).
On completion of works the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm all of the mitigation and enhancement measures have been implemented in accordance with the details approved under this condition. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 (as amended).
Notwithstanding the details shown on the approved plans, the roof of the extensions hereby permitted shall be a living roof of meadow mix planting. The planting shall be carried out in the first planting season following the first occupation/use of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any plants that die, or  are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar species. Reason: To ensure that the new development is in keeping with the surroundings and is appropriate to the character of the Malvern Hills Area of Outstanding Natural Beauty and represents high quality design in accordance with policies SWDP21, SWDP23 and SWDP25 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice - seeking further information following receipt of the application - seeking amendments to the proposed development following receipt of the application - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
It should be noted that the roof void of the main house is a bat roost. The applicant should be aware that bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017 (as amended), the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. Therefore, any works to that part of the dwelling would require further bat survey work and may require a bat licence.
