Malvern Hills District Council, The Council House, Avenue Road, Malvern, Worcestershire WR14 3AF HEREBY CERTIFY that application reference 19/01898/CLPU registered on 20 January 2020 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and on the plan attached to this Notice, as the matter described in the First Schedule to this Notice would not be lawful as at the 20 January 2020 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- The applicant has failed to submit clear and precise plans and the proposed floorplan demonstrates that the single storey side elevation would not join the original side elevation of the dwelling and would join the proposed two storey rear extension on the south east corner thus resulting in the combined extensions having a width greater than half the width of the original dwelling and the proposal therefore fails to accord with paragraph A.1 part (j) iii of Class A, Schedule 2, Part 1 of the Town and Country (General Permitted Development) Order 2015 (as amended). In addition the proposed extension does not match the appearance of the existing dwellinghouse and does not incorporate windows that match the windows of the ordinal dwellinghouse in terms of their overall shape or the size of the frames and the proposal does not comply with condition A.3 (a) of Class A, Schedule 2, Part 1 of the Town and Country (General Permitted Development) Order 2015 (as amended). The applicant has also failed to submit clear and precise plans to demonstrate that the resultant roofspace would not exceed 50 cubic metres and at present there is reasonable doubt that the resultant roof space would exceed the 50 cubic metre threshold and would fail to accord with paragraph B.1 part (d) of Class B, Schedule 2, Part 1 of the Town and Country (General Permitted Development) Order 2015 (as amended). Consequently, the matter described in the First Schedule constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended) and requires an express planning permission. |
