The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – SJD-117-003 Rev C.
Reason: To define the permission. |
Prior to the commencement of development samples and trade descriptions of the external facing and roofing materials to be used in the construction of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved detail.
Reason: To ensure that the new materials are in keeping with the surroundings in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.

Before the commencement of construction works on the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan) showing the layout of proposed tree, hedge and shrub planting areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding shall be carried out in accordance with the approved details in the first planting season following the completion or first use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Notwithstanding the detaiuls shown on Drawing No. SJD-117-003 Rev C before the first occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details.
Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.. |
Unless otherwise agreed by the Local Planning Authority development, other than that required to be carried out as part of an approved scheme of remediation, must not commence until conditions 1 to 5 have been complied with:
1.Previous reports submitted to the Local Authority in support of the application has identified unacceptable risk(s) exist on the site as represented in the Conceptual Site Model. A scheme for detailed site investigation must be submitted to and approved in writing by the Local Planning Authority prior to being undertaken to address those unacceptable risks identified. The scheme must be designed to assess the nature and extent of any contamination and must be led by the findings of the preliminary risk assessment. The investigation and risk assessment scheme must be compiled by competent persons and must be designed in accordance with DEFRA and the Environment Agency’s “Model Procedures for the Management of Contaminated Land, CLR11”
2.Detailed site investigation and risk assessment must be undertaken and a written report of the findings produced. This report must be approved by the Local Planning Authority prior to any development taking place. The investigation and risk assessment must be undertaken by competent persons and must be conducted in accordance with DEFRA and the Environment Agency’s “Model Procedures for the Management of Contaminated Land, CLR11”
3.Where identified as necessary a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
4.The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development, other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
5.Following the completion of the measures identified in the approved remediation scheme a validation report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings.
6.In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where necessary a remediation scheme must be prepared, these will be subject to the approval of the Local Planning Authority. Following the completion of any measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority prior to the occupation of any buildings.
Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy SWDP 31 of the South Worcestershire Development Plan.

Development shall not begin until visibility splays are provided from a point 0.6m above carriageway level at the centre of the access to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 33 metres in each direction measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.
In the reasons of highway safety in accordance with Policy SWDP 4 of the South Worcestershire Development Plan. |
The Development hereby approved shall not be occupied until the access, turning area and parking facilities shown on Drawing Reference SJD-117-003 Rev C has been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times.
Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policy SWDP 4 of the South Worcestershire Development Plan. |
The Development hereby approved shall not commence until a Construction Environmental Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:-
• Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway;
• Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc);
• The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring.
• Details of any temporary construction accesses and their reinstatement.
• A highway condition survey, timescale for re-inspections, and details of any reinstatement.
The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority.
Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with Policy SWDP 4 of the South Worcestershire Development Plan. |
Prior to first occupation of the development hereby permitted a scheme shall be submitted to and agreed in writing with the Local Planning authority setting out the following:
i) the tenure, mix and location of the affordable units;
ii) the arrangements to ensure that the affordable housing remains as affordable housing for both first and subsequent occupiers of the affordable housing; and
ii) the occupancy criteria.
For the purposes of this condition 'affordable housing' has the meaning ascribed to it by the National Planning Policy Framework. The affordable housing shall be provided in accordance with the approved scheme.
Reason: In the interests of securing affordable housing in accordance with SWDP 2 and SWDP 15 of the South Worcestershire Development Plan |
Prior to the commencement of the development a Water Management Statement, setting out water efficiency measures, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use and retained thereafter.
Reason: To ensure water management is taken into account in the development in accordance with SWDP 30 of the South Worcestershire Development Plan. |
Prior to installation, details of broadband provision shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use and retained
thereafter.
Reason: To ensure that the development is provided with adequate broadband provision in accordance with Policies SWDP26 of the South Worcestershire Development Plan |
No development shall commence until, details of sustainability measures from renewable or
low carbon sources equivalent to at least 10% of predicated energy requirements to be
incorporated into the design of the dwelling hereby approved, to reduce energy usage and
running costs for future occupiers have been submitted to and approved in writing by the
Local Planning Authority. The approved details shall be implemented in accordance with a
timetable to be approved in writing by the Local Planning Authority and retained thereafter.
Reason: To ensure sustainability measures are taken into account in the development in
accordance with Policies SWDP21 and SWDP27 of the South Worcestershire Development
Plan |
Demolition/ground works/construction work shall not take place outside the following hours:
Monday to Friday 07.30-19.00 hrs
Saturdays 07.30-13.00hrs.
There shall be no such work on Sundays, Bank or Public Holidays.
Reason: To protect the residential amenities of the area in accordance with Policy SWDP 21
of the South Worcestershire Development Plan. |
Prior to the commencement of the development hereby approved, a specification (including methodology and programme of implementation) for the enhancement of biodiversity through he provision of features including a minimum of tow bat and two bird nesting boxes to be installed on or within the vicinity of the new dwellings shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall also include wildlife friendly planting. The works so approved, shall be carried out in accordance with the approved programme of implementation.
Reason: To enhance biodiversity on accordance with Policy SWDP 22 of the South Worcestershire Development Plan and paragraph 118 of the National Planning Policy Framework.

Any proposals to alter existing, or construct new, culverts or carry out works in or on an ordinary watercourse will need Land Drainage Consent under s.23; Land Drainage Act 1991 from SWLDP. Such consent will need to be granted prior to any works commencing on site as consent cannot be granted retrospectively. Failure to comply may result in enforcement action being taken by the Lead Local Flood Authority, Worcestershire County Council, under the Act. SWLDP may also exercise powers to require works for maintaining flow of a watercourse where appropriate under s.25 of the Act where the proper flow of water is impeded. |
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
No Drainage to Discharge to Highway

Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway. |
