Development under Class Q is permitted subject to the condition that development under Class Q (a) and Class Q (b) must be carried out in accordance with the approved plans , 1787/05B, 1787/03B, 1787/04A. Reason: To define the permission.
Development, other than that required to be carried out as part of an approved scheme of remediation, shall not commence until Parts 1 to 6 have been complied with: Part 1 A preliminary risk assessment shall be carried out. This study shall take the form of a Phase I desk study and site walkover and shall include the identification of previous site uses, potential contaminants that might reasonably be expected given those uses and any other relevant information. A preliminary risk assessment report including:- - a diagrammatical representation (conceptual model) based on the information above; and - all potential contaminants, sources and receptors to determine whether a site investigation is required shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of construction works on the development hereby approved. Part 2 Where an unacceptable risk is identified and prior to the commencement of construction work on the development hereby permitted a scheme for detailed site investigation shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be designed to assess the nature and extent of any contamination and shall be led by the findings of the preliminary risk assessment. Part 3 Where part 2 applies, a detailed site investigation and risk assessment shall be undertaken in accordance with the approved scheme required under Part 2 and a written report of the findings produced, submitted to and approved in writing by the local planning authority. The investigation/assessment shall be approved prior to the commencement of construction works on the development hereby approved. Part 4 Where identified as necessary in the report approved under Part 3, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors shall be produced, submitted to and approved in writing by the local planning authority. The scheme shall include an implementation programme. The scheme shall be approved prior to the commencement of construction works on the development hereby approved. Part 5 The remediation scheme approved under Part 4 shall be carried out in accordance with the approved implementation programme. Part 6 Following the completion of the measures identified in the remediation scheme approved under Part 4, a validation report that demonstrates the effectiveness of the remediation carried out shall be produced, submitted to and approved in writing by the Local Planning Authority. None of the development hereby approved shall be occupied/first used until the validation report has been approved. Part 7 In the event that contamination is found at any time when carrying out the approved development that was not previously identified in the report approved under Part 3, construction works shall cease and this shall be reported immediately in writing to the Local Planning Authority. In such circumstances an investigation and risk assessment must be undertaken and a revised remediation scheme must be produced, submitted to and approved in writing by the Local Planning Authority. Development works shall not resume until the revised remediation scheme has been approved in writing. The measures as set out in the revised remediation scheme shall be carried out. Following the completion of any measures identified in the approved revised remediation scheme a validation report must be produced, submitted to and approved in writing by the Local Planning Authority. None of the development hereby approved shall be occupied/first used until the validation report has been approved. Reason: To ensure that the proposed development avoids significant adverse impacts from pollution in accordance with policy SWDP31 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Greenscape Environmental report dated September 2017. In particular: • An ecologist will inspect the buildings immediately prior to works commencing. • The developer and contractors will be made aware that there is a possibility that bats may be found during works and will be advised to work in a way to ensure bats are not harmed during any re-roofing works. They will be provided with a simple emergency procedure to follow if bats are found at any stage of the work on site. It will be ensured the method statement is on site. • An ecologist will be present on site when the roof is removed carefully by hand, particularly the ridges and around edges. • If a bat is found when the ecologist is not present then work will stop in that area immediately and the ecologist contacted for advice.
Works to the roof and window shall not commence unless the local planning authority has been provided with a bat European Protected Species licence issued by Natural England. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Full details for bat roost compensation and enhancement measures to include specifications, methodology and implementation shall be submitted to and approved in writing prior to the commencement of the development. These shall include recommendations set out Greenscape Environmental report dated September 2017. In particular: • Gaps will be created by leaving a 20mm gap at the end of ridge tiles every 3m along the roof sections along Buildings 1 and 4. • Lining material under the ridge will be Bitumen Hessian material to BS747 (F1) so bats cannot come into contact with modern breathable membranes. • Provision will be made for roosting opportunities for bats with the conversion of the existing vents, this will make use of an existing feature retaining the character of the buildings. • The vents should be sealed off from the main building, and the tiles lined with a bitumen hessian lining, the addition of rough boarding behind the slats themselves would allow for roosting opportunities. • At least one Schwegler bat box will be erected on the northern gable end at a height of 3-4m and in a southerly, westerly or easterly facing direction. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to occupation a ‘lighting design strategy for biodiversity’ shall be submitted to and approved in writing by the local planning authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Greenscape Environmental report dated September 2017. In particular: • All work will be conducted during daylight hours as newts are least likely to move during this time. • Any heavy machinery will be stored on an area of hard standing. • Stored material will be raised on pallets to reduce the potential they might act as a temporary resting place. • All waste will be placed straight into skips to reduce the potential of creating refugia. • Trenches will be dug and filled in on the day created or will be covered over and checked the following morning. • If a newt is found then work WILL stop immediately and the consultant contacted for advice. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Greenscape Environmental report dated September 2017. In particular: • Work will commence out of the bird nesting season, which is March to August inclusive. If this is not possible, a suitably experienced ecologist will conduct a check immediately prior to work starting to ensure no nesting birds will be affected. • All nesting birds will be left undisturbed until young have fledged. A 4m buffer will be left. 7. Full details for bird nesting compensation and enhancement measures to include specifications, methodology and implementation shall be submitted to and approved in writing prior to the commencement of the development. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
