Condition Details / Information Notes
The development hereby approved shall be carried out in accordance with the following drawings- • Site Plan • Development Access Right Turn Lane Layout 21772_08_020_01 Reason: To define the permission and to ensure that the development is provided with safe access.
All future applications for the approval of reserved matters shall be broadly in accordance with the principles and parameters described and illustrated in the updated Design & Access Statement dated June 2016. All reserved matters applications shall include a statement providing an explanation as to how the design of the development responds to the details submitted as part of the outline application. Reason: To ensure that the development is provided with safe access and meets the design quality and environmental requirements of the Development Plan.
Approval of the details of the appearance, layout, scale of the buildings and the landscaping of the site and including the provision of the on-site recreation/open play space hereinafter called "the reserved matters", shall be obtained from the Local Planning Authority in writing for each phase of the development before any development within each phase is commenced and the development of each phase shall be carried out as approved. Reason: To comply with the requirements of Section 92 of the Town and Country Planning Act 1990 (as amended).
No development shall take place until a Phasing Plan for the housing development hereby permitted has been submitted to and approved in writing by the local planning authority. The Phasing Plan shall include details of: i) the timing of the provision of infrastructure to serve the proposed development including road improvements; and ii) the timing of biodiversity, SUDS and strategic landscaping features; Nothing in the Phasing Plan shall conflict with any of the conditions attached to this planning permission or any of the provisions within the associated S106 Legal agreement. The applications for approval of reserved matters shall be made for each phase in accordance with the Phasing Plan and the development shall be carried out in accordance with the approved Phasing Plan. Reason: To ensure the proposed development is constructed with the necessary infrastructure including recreation facilities and enhancements to biodiversity.
Applications for the approval of all the reserved matters of the development shall be made to the Local Planning Authority before the expiration of three years from the date of this permission. This shall be in the form of a 'reserved matters' application. The development of each phase hereby permitted shall be begun not later than whichever is the latest of the following dates:- i. The expiration of three years from the date of this permission, or ii. The expiration of two years from the final approval of the reserved matters, or iii. In the case of approval on different dates, the final approval of the last such matter to be approved. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act
The on-site public open space including locally equipped area for play (LEAP of not less than 400 square metres with at least five activities) shall be provided, before 75% of the dwellings approved as part of the reserved matters relating to layout are first occupied and retained for those purposes for the lifetime of the development. Reason: To ensure a satisfactory environment is provided for occupiers of the development and that the public open space is provided as soon as reasonably practicable in accordance with Policies SWDP 5 and 21 of the South Worcestershire Development Plan.
A Green Infrastructure, SuDS and Biodiversity management and maintenance plan, including any phased implementation, long term design objectives, management responsibilities and maintenance schedules for all Green Infrastructure, SuDS and Biodiversity areas, other than privately owned domestic gardens, shall be submitted to and approved in writing by the Local Planning Authority prior to the occupation of any dwelling or employment building hereby approved. The maintenance and management plan shall make provision for monitoring of the performance of the GI, SuDS and Biodiversity features for a period of at least 5 years post their construction. The management and maintenance plan shall be implemented and the maintenance schedules adhered to as approved for the lifetime of the development. Reason: To ensure that the development is properly drained, avoiding flood risk and pollution in accordance with Policies SWDP 28, 29 and 31 of the South Worcestershire Development Plan and in the interests of visual and residential amenity in accordance with Policies SWDP 5, 21, 22, 25 and 29 of the South Worcestershire Development Plan and appropriate provision is made for the environmental and ecological mitigation in accordance with policy SWDP22 of the South Worcestershire Development Plan.
No development shall commence until full details of all landscaping works for that phase have been submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include details of the following: • all existing trees and hedgerows on site (including details of location, canopy spread, species and proposed pruning/felling and changes in ground levels); • a plan showing the layout of proposed tree, hedge, shrub planting as well as grassed areas; • a proposed planting schedule including details detailing the disposition of planting, cross referenced to a schedule listing the species, size and number and densities; • a written specification setting out cultivation and other operations associated with plant and grass establishment. All planting and seeding/ turfing shall be carried out in accordance with the approved details in the first planting and seeding/ turfing seasons following the completion or first occupation of the development, whichever is the sooner. If within a period of five years from the date of the planting of any tree planted pursuant to this condition that tree, or any tree planted in replacement for it is removed, uprooted or destroyed or dies, or becomes, seriously damaged or defective, another tree of the same species and size as that originally planted shall be planted at the same place, unless the Local Planning Authority gives its written approval to any variation. Reason: To ensure the environment of the development is improved and enhanced in accordance with Policy SWDP 25 of the South Worcestershire Development Plan.
The reserved matters application in respect of landscaping shall include a scheme for the re-establishment of hedgerows set behind the required visibility splays either side of the vehicular access point off the A44, as well as details of a proposed management plan for the care of the new hedgerows for a period of at least five years after first planting. The development shall be carried out in accordance with the approved details and the hedgerows retained thereafter. Reason: To ensure the environment of the development is improved and enhanced in accordance with Policy SWDP 25 of the South Worcestershire Development Plan.
With the exception of the hedgerow that would be required to be removed to provide the required visibility splays (as specified within condition 14), and the approved access points, no other existing trees or hedgerows shall be destroyed or removed from the site, unless previously approved in writing by the Local Planning Authority as part of any landscaping scheme approved as part of any reserved matters application. Reason: To ensure the environment of the development is protected in accordance with Policy SWDP 25 of the South Worcestershire Development Plan.
Prior to the commencement of the development, a tree and hedgerow protection plan for that phase shall be submitted to and approved in writing by the local Planning Authority, which relates to all of the trees and hedges within the Phase which are to be retained. The development shall subsequently be carried out in accordance with the approved protection plan. Reason: To prevent unnecessary damage to trees in accordance with Policies SWDP 21 and 25 of the South Worcestershire Development Plan.
All existing trees and hedges (other than those indicated on the approved plans as to be removed) shall be retained and shall not be felled, grubbed out or otherwise removed within a period of five years from the completion of development without the prior written consent of the Local Planning Authority. Reason: To prevent unnecessary damage to trees in accordance with Policies SWDP 21 and 25 of the South Worcestershire Development Plan.
No site clearance, excavations or building operations of any type shall commence until a protective fence (of at least 2 metres in height and in all other respects in accordance with BS 5837 (2012) Trees in Relation to Design, Demolition and Construction and previously approved in writing by the Local Planning Authority), has been erected around the trees and hedgerows to be retained within the site and around those trees and hedges outside the site or along the site boundaries, whose Root Protection Areas (RPA) (as defined in BS 5837 (2012)) fall within the site, at the outer limit (or beyond) of the their RPA or in a position agreed in writing by the Local Planning Authority. This tree protective fencing shall remain in place until all construction and associated ground-works have been completed. If any retained tree or hedge is removed, uprooted or destroyed or dies, replacement planting shall be carried out in the first available planting season of such species, sizes and numbers and in positions on site to replace that which has been lost. Reason: To avoid unnecessary damage to and secure the well-being of the trees and hedges to be retained in accordance with Policies 21 and 25 of the South Worcestershire Development Plan.
No materials shall be stored, temporary buildings erected or ground levels altered within the Root Protection Area (RPA) (as defined in BS 5837 (2012) Trees in Relation to Design, Demolition and Construction) of any tree retained on site or of any tree beyond the site perimeter whose RPA lies within the site, unless agreed in writing by the Local Planning Authority. Reason: To prevent unnecessary damage to trees in accordance with Policies SWDP 21 and 25 of the South Worcestershire Development Plan.
The development hereby permitted shall not be first occupied until the access works shown on drawing 21772_08_020_01 rev C have been constructed and completed. Reason: To ensure the safe and free flow of traffic onto the highway.
Prior to the occupation of the 101st dwelling an emergency access or full vehicle link shall be provided at a location and in accordance with a specification that has been submitted to and approved in writing by the Local Planning Authority. This access shall be retained for the lifetime of the development. Reason: To ensure continuous access to the highway and for improve sustainable travel permeability.
No buildings shall be first occupied until a scheme for the provision of secure cycle parking for the dwellings or employment premises within the respective phase has been submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the approved details, implemented prior to the occupation of each building to which the cycle parking relates and maintained thereafter in-perpetuity. Reason - To ensure adequate provision of cycle parking is provided and help to encourage the use of sustainable modes of travel in accordance with Policy SWDP4 d) of the South Worcestershire Development Plan.
No development shall commence within each Phase until details of the proposed Sustainable Drainage System for that Phase has been submitted to and agreed in writing by the Local Planning Authority. The submitted details shall include for each Phase: i. Information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; ii. A timetable for its implementation; iii. Details of field percolation tests, if infiltration techniques are used. The submitted scheme shall result in no increase in surface water run-off rate and volume from the site compared to the existing pre-application runoff rate and volume up to a 1 in 100 year storm event plus an appropriate allowance for climate change (at least 30%). The scheme shall provide an appropriate level of runoff treatment. The scheme shall be implemented for each Phase in accordance with the approved details before the development in each Phase is first occupied. Reason: To ensure that the development is properly drained, avoiding flood risk and pollution in accordance with Policies SWDP 28, 29 and 31 of the South Worcestershire Development Plan.
Prior to the commencement of the development hereby approved, a specification (including methodology and programme of implementation) for the enhancement of biodiversity through the provision of features including bat and bird boxes and holes at ground level in boundary walls and fences for hedgehogs to pass through (following the principles set out in the submitted ecological appraisal and protected species report), shall be submitted to and approved in writing by the Local Planning Authority. The works so approved shall be carried out in accordance with the approved programme of implementation and be retained thereafter for the lifetime of the development. Within three months of the first occupation of the last dwelling to be constructed pursuant to reserved matters approval relating to layout, the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm whether all of the measures for enhancing biodiversity have been implemented in accordance with the details approved under this condition. Reason: To enhance biodiversity in accordance with Policy SWDP 22 of the South Worcestershire Development Plan.
No development shall take place within each Phase until the proposed route and point of discharge for the restricted surface water discharge from the respective Phase, along with evidence of any necessary approvals, has been submitted to and approved in writing by the Local Planning Authority. The approved scheme for each phase shall be completed before the relevant Phase are first occupied. Reason: To ensure that the development is properly drained, avoiding flood risk and pollution in accordance with Policies SWDP 28, 29 and 31 of the South Worcestershire Development Plan. It should be noted that flow routes through gardens and other areas in private ownership will not be permitted
No development shall take place until details of a phased drainage scheme, that has been informed by an assessment of the hydrological and hydrogeological context of the development in relation to the disposal of surface water and an assessment of the need for improvements to the public foul sewerage system necessary to ensure that there is sufficient capacity within the public sewerage system to accommodate the development, has been submitted to and approved in writing by the local planning authority. No dwellings within the respective Phase hereby permitted shall be first occupied until the drainage scheme approved by the local planning authority has been implemented and the works completed in accordance with the approved details. Reason - To ensure that the development is provided with a satisfactory means of drainage as well as to reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution in accordance with Policies SWDP 28, 29 and 31.
Prior to the commencement of development, a noise survey in relation to the proposed residential properties shall have been submitted to and approved, in writing, by the Local Planning Authority. The survey shall have been undertaken by a competent person, shall include periods for daytime as 0700-2300 hours and night-time as 2300-0700 hours, and identify appropriate noise mitigation measures. All residential units shall thereafter be designed so as to achieve as far as practicable the noise criteria based on current figures by the World Health Authority Community Noise Guideline Values/BS8233 conditions given below: • Dwellings indoors in daytime: 35 dB LAeq,16 hours • Outdoor living area in day time: 55 dB LAeq,16 hours • Inside bedrooms at night-time: 30 dB LAeq,8 hours (45 dB LAmax) • Outside bedrooms at night-time: 45 dB LAeq,8 hours (60 dB LAmax) Such detail and appropriate consequential noise mitigation measures as shall have been agreed, in writing, by the Local Planning Authority shall be implemented prior to occupation of any of the dwellings hereby approved and shall be maintained as agreed thereafter. Reason: To ensure that the development hereby permitted is not detrimental to the amenity of the future residents by reason of undue external noise where there is insufficient information within the submitted application in accordance with SWDP31.
Any section of existing hedgerow required to be removed to facilitate the new accesses shall not be removed between March and August inclusive unless preceded by a thorough survey for nesting birds undertaken by an appropriately qualified ecologist. If required to carried out to comply with this condition, a report of the survey and recommendations prepared by that ecologist shall be submitted to and approved in writing by the Local Planning Authority before any relevant phase of the development commences. Reason: To ensure that wild birds are suitably protected, having regard to the Wildlife & Countryside Act 1981 (As amended).
No development shall commence until a detailed plan showing the levels of the existing site, the proposed Finished Floor Levels of any proposed building and a datum point outside of the site, and a construction method statement for any ground works and changes of levels/ construction of all ground retaining features in the vicinity of retained trees and hedgerows, has been submitted to and approved by the Local Planning Authority. The development of each Phase shall be carried out in accordance with the approved details. Reason: To define the permission and ensure that the development is of a scale and height appropriate to the site and surrounding area in accordance with Policies 21 and 25 of the South Worcestershire Development Plan.
No development shall commence until a Construction Environmental Management Plan (CEMP) has been submitted to and approved in writing by the Local Planning Authority. The CEMP should generally comply with the requirements of Worcestershire Regulatory Services Code of Best Practice for demolition and Construction Sites 1st Edition July 2011. The CEMP shall include for each respective Phase the following:- a. details to minimise the impact of noise, vibration and dust etc. from construction and site clearance activities and the traffic associated with this development, including a scheme for wheel cleaning; b. Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc); c. Means of vehicular traffic access for construction vehicles; d. Restrictions on burning; e. details in relation to the prevention of pollution of waterways; and f. details on mitigation and avoidance measures to ensure that potential impacts on Badgers are avoided during construction. The measures set out in the approved CEMP shall be carried out in full during the construction of each phase of the development hereby approved. Reason: To protect existing and new occupiers of residential areas from the unreasonable effects of noise, vibration, light and dust nuisance and to avoid and mitigate for any potential impact on protected species in accordance with Policies SWDP21 and 22 of the South Worcestershire Development Plan.
Demolition/ground works/construction works/ deliveries and collections during the construction phase of the development, shall not take place outside the following hours: Monday to Friday 07.30 – 18.00hrs Saturday 08.00-13.00hrs There shall be no work on Sundays or Public Holidays Reason: To protect the residential amenities of existing and new occupiers of residential areas in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
No development shall commence until an external lighting scheme is submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason: To protect the potential habitat and foraging routes of bats which are protected under the Natural Environment and Rural Communities (NERC) Act, 2006, The Conservation of Habitats and Species Regulations, 2010, The Wildlife and Countryside Act, 1981(as amended), The Countryside and Rights of Way (CRoW) Act, 2000, Habitats Directive and in accordance with Policies SWDP21, 22 and 31 of the South Worcestershire Development Plan.
No development shall take place until a programme of archaeological investigation, including a Written Scheme of Investigation, has been submitted to and approved in writing by the local planning authority. The scheme shall include an assessment of significance and research questions; and: a) The programme and methodology of site investigation and recording. b) The programme for post investigation assessment. c) Provision to be made for analysis of the site investigation and recording. d) Provision to be made for publication and dissemination of the analysis and records of the site investigation e) Provision to be made for archive deposition of the analysis and records of the site investigation f) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under (a) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: To ensure that any archaeological remains are preserved and properly recorded in accordance Policies SWDP 6 and 24 of the South Worcestershire Development Plan and the requirements of paragraph 141 of the National Planning Policy Framework.
Prior to the construction of any of the dwellings hereby approved, details of proposed utilities connections to facilitate super-fast broadband connectivity including fibre optic rather than copper cabling where practicable shall be submitted to an approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason: To ensure that the new development includes broadband that allows residents and employers/employees to choose how they work, how they interact with services and facilities and to provide a greater opportunity for home working and a reduction in car based commuting in accordance with Policy 26 of the South Worcestershire Development Plan.
No development shall commence until the following details have been submitted to and approved in writing by the local planning authority: i) details on how on-site micro–generation to meet at least 10% of the households predicted energy requirements from renewable or low carbon sources equivalent to at least 10% of predicted energy requirements; ii) details of measures to conserve and recycle water to be incorporated into the proposed development; iii) details of energy efficiency measures to be incorporated into the proposed development; and iii) details of construction materials to be used in the proposed development with the aim of minimising the use of primary non-sustainable materials. iv) Details of residential waste (for landfill) storage and the separation and storage of recyclable materials. If photovoltaic roof panels are proposed, a plan shall be submitted to and approved in writing by the Local Planning Authority showing the location of these on the roofs of the buildings. The development shall be carried out in accordance with the approved details and retained thereafter unless replaced with panels of the same or improved specification and performance. Reason: To reduce carbon emissions and secure sustainable energy solutions in accordance with Policy SWDP 27 of the South Worcestershire Development Plan.
Details shall be submitted to and approved in writing by the local planning authority prior to the first occupation of the development for the installation of UltraLow NOx boilers with maximum NOx Emissions less than 40 mg/kWh. The details as approved shall be implemented prior to first occupation of the building to which they relate. The boilers shall be retained thereafter unless they need to be replaced in which case the replacement boiler shall be of the same specification or have a lower NOx emission output. Reason: To reduce pollution in accordance with Policy SWDP31 of the South Worcestershire Development Plan and in accordance with Paragraph 35 of the Framework.
Appropriate cabling and an outside electrical socket shall be supplied for each dwelling to enable ease of installation of an electric vehicle charging point (houses with dedicated parking) and be operational before the respective dwelling is first occupied. For developments with unallocated parking i.e. flats/apartments, at least 1 EV charging point per building (as a minimum) shall be provided and be operational before the respective building is first occupied. The charging points must comply with BS:7671. The sockets shall comply with BS:1363, and shall be provided with a locking weatherproof cover if located externally to the building. Reason: To reduce pollution in accordance with Policy SWDP31 of the South Worcestershire Development Plan and in accordance with Paragraph 35 of the Framework.
This decision notice should be read in conjunction with the terms of the S106 legal agreement of even date. You are advised to satisfy yourself that you have all of the relevant paperwork. The attention of the applicant is drawn to the need to keep the Highway free from any mud or other material emanating from the application site of any works pertaining thereto. The permission does not authorise the stopping up or diversion of the right of way. The right of way may be stopped up or diverted by Order under Section 257 of the Town and Country Planning Act, 1990, provided that the Order is made before the development is carried out. If the right of way is obstructed before the Order is made, the Order cannot proceed until the obstruction is removed. This permission does not authorise the laying of private apparatus within the confines of the public highway. The applicant should apply to the Worcestershire County Council’s Network Control Manager, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Streetworks Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority. This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor following the issue of a license under Section 184 and 278 of the Highways Act, 1980. The applicant should contact Worcestershire County Council’s Highways Network Control Manager, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845607 2005), regarding the issue of the necessary license authorising the access works to be carried out by the County Council’s Approved Contractor at the applicant’s expense. No work on the site should be commenced until engineering details of the improvements to the Public Highway have been submitted to and approved by the Highway Authority and an agreement under Section 278 of the Highways Act 1980 entered into. If it is the Developer's intention to request the County Council, as Highway Authority, to adopt the proposed roadworks as maintainable at the public expense, then details of the layout and alignment, widths and levels of the proposed roadworks, which shall comply with any plans approved under this planning consent unless otherwise agreed in writing, together with all necessary drainage arrangements and run off calculations shall be submitted to the County Council's Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No works on the site of the development shall be commenced until these details have been approved and an Agreement under Section 38 of the Highways Act, 1980, entered into. It is not known if the proposed roadworks can be satisfactorily drained to an adequate outfall. Unless adequate storm water disposal arrangements can be provided, the County Council, as Highway Authority, will be unable to adopt the proposed roadworks as public highways. The applicant is, therefore, advised to submit the Engineering details referred to in this conditional approval to the County Council's County Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP at an early date to enable surface water disposal arrangements to be assessed. This consent does not authorise the erection of temporary direction signs on the Public Highway. Should the applicant wish to direct traffic to the development site they should seek the consent of the Highways Authority. All temporary directional sign proposals should be submitted to the Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No signs should be erected without the consent of the Highway Authority.
