Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information provided on the application form and the following plans/drawings – 1:20,000 location plan and 1:2,500 site layout plan. Reason: To define the permission.
Before the first use of the facilities hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDP 21 and SWDP 25 of South Worcestershire Development Plan.
Development shall not take place until a scheme of surface water drainage, which shall include proposals for sustainable drainage, (SuDS), has been submitted to, and approved in writing by the Local Planning Authority. The approved scheme shall be completed before the development is first brought into use, or in accordance with a timetable to be submitted to and agreed in writing by the Local Planning Authority. Reason: To ensure satisfactory drainage of the site and to prevent the increased risk of flooding by ensuring a satisfactory means of surface water disposal, in accordance with Policy SWDP 29 of the South Worcestershire Development Plan.
Prior to the commencement of development, details of refuse storage facilities to serve the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. The approved refuse storage facilities shall be implemented prior to the first use of the facilities hereby approved and retained thereafter. Reason: To ensure adequate refuse storage facilities are incorporated in the development in accordance with Policies SWDP 21 and SWDP 33 of the South Worcestershire Development Plan.
No floodlighting shall be installed or otherwise erected to serve the facilities hereby permitted. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of this rural area in accordance with Policies SWDP 21 and SWDP 25 of South Worcestershire Development Plan.
No temporary buildings, containers or other structures, including toilets, storage facilities and changing rooms, shall be stationed on the land without details first being approved in writing by the Local Planning Authority. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of this rural area in accordance with Policies SWDP 21 and SWDP 25 of South Worcestershire Development Plan.
The development hereby permitted shall not be brought into use or occupied until the access, turning area and parking facilities shown on the approved plan have been provided. These areas shall thereafter be retained and kept available for those users at all times. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
The development hereby permitted shall not be first brought into use until the first 10 metres of the access, measured from the edge of the carriageway, has been constructed to a minimum width of 5.5 metres and surfaced in a bound material. The access shall thereafter be maintained as such. Reason: In the interests of highway safety.
Any new access gates shall be set back 10 metres from the adjoining carriageway edge, and shall be made to open inwards only. Reason: In the interests of highway safety.
No part of the development hereby permitted shall begin until a Construction Management Plan to include details of: a. Parking for site operatives and visitors b. Area for site operatives' facilities c. Parking and turning for delivery vehicles d. Areas for the storage of plant and materials e. Wheel washing equipment has been submitted to, and approved in writing by, the Local Planning Authority. Only the approved Plan shall be implemented throughout the construction period. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information following receipt of the application and considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
Any proposals to alter existing, or construct new, culverts or carry out works in or on an ordinary watercourse will need Land Drainage Consent under s.23; Land Drainage Act 1991 from SWLDP. Such consent will need to be granted prior to any works commencing on site as consent cannot be granted retrospectively. Failure to comply may result in enforcement action being taken by the Lead Local Flood Authority, Worcestershire County Council, under the Act. SWLDP may also exercise powers to require works for maintaining flow of a watercourse where appropriate under s.25 of the Act where the proper flow of water is impeded.
The attention of the applicant is drawn to the need to keep the highway free from any mud or other material emanating from the application site or any works pertaining thereto.
This permission does not authorise the laying of private apparatus within the confines of the public highway. The applicant should apply to the Worcestershire County Council's Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Street works Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council's Approved Contractor following the issue of a license under Section 184 and 278 of the Highways Act, 1980. The applicant should contact Worcestershire County Council's Highways Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), regarding the issue of the necessary license authorising the access works to be carried out by the County Council's Approved Contractor at the applicant's expense. The applicant should give the County Council sufficient notice to enable, as far as possible, the licence procedure to be carried out so that there is no disruption to the applicant's programme of works.
Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.
