Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information provided on the application form and the following plans/drawings – • Location plan 1952 1000 Rev B • Block plan 1952 1100 Rev B • Proposed floor plans 1952 3000 Rev C • Proposed elevations and sections 1952 3100 Rev C Reason: To define the permission.
Notwithstanding the details submitted with the application, prior to the commencement of the development hereby approved details of the materials to be used in the construction of the external surfaces of the development hereby permitted shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour and texture of roofing materials; - glass to glass corner detail - sample panel of the curtain wall glazing to the parapet and fretted glass spandrel panel - detailed specification of all new joinery including dimensions, profile and a description of the stain or paint finish to be applied to the joinery; - external joinery details along with architectural details of the proposed external finishes to include window heads and sills of the proposed entrance lobby; - window sections, eaves and verges; - details of any external vents. The development shall be carried out using the materials as approved. Reason - To ensure that the development is of an appropriate design quality in keeping with the character and appearance of the surrounding area in accordance with policies SWDP6, 21 and 24 of the South Worcestershire Development Plan.
Notwithstanding the details submitted with the application, prior to the commencement of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan showing the layout of proposed tree, hedge and or shrub planting. (ii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iii) a written specification outlining cultivation and other operations associated with plant establishment. (iv) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting shall be carried out in accordance with the approved details in the first planting season following the first use of the development. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Notwithstanding the details submitted with the application, prior to the commencement of the development hereby permitted details including samples of the proposed materials for the hard landscaping of the site (including paths, ramps, walls including capping, steps and any other hard surfaces forming part of the proposed landscaping) shall be submitted to and approved in writing by the Local Planning Authority. The hard landscaping of the site shall be completed before the extension is first brought into use. The development shall be carried out in accordance with the approved details. Reason - To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development hereby approved shall be carried out in accordance with the recommendations contained within the Ecological Survey and Report submitted with the application. The development shall include but not be limited to: 1. A licensed bat worker shall remain ‘on call’ during the development works. In the event that roosting bats are discovered, works must cease immediately and Natural England must be contacted to advise on any licensing requirements to allow lawful completion of the work. 2. A bat box shall be installed within the application site. The box shall be fixed to a built structure (such as the Beaumaris Woodstone Bat Box or 1FQ Schwegler Bat Roost) in a location that has previously been agreed in writing by the Local Planning Authority. The box shall be installed at least 3m above ground-level, and not placed directly above any windows. If the development commences later than 12 months of the date of the applicant’s Ecological Survey and Report, an update survey shall be commissioned to determine the status of the site during the intervening period and submitted to the Local Planning Authority. The development shall be carried out in accordance with any further recommendations. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Before the development hereby permitted is first brought into use details of any external lighting to be provided in association with the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority. Only external lighting in accordance with approved details shall be installed on the extension or at ground level for the purpose of illuminating the proposed extension. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) no other external lighting shall be installed. Reason: To ensure the development is appropriate to the setting of heritage assets and to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policies SWDP6, 24 and 22 of the South Worcestershire Development Plan.
Before the development hereby approved is first brought into use, details of any signage to be attached to the extension hereby approved shall be submitted to and approved in writing by the Local Planning Authority. No other signage shall be attached to the extension. Reason: To ensure the development is appropriate to the setting of heritage assets in accordance with policies SWDP6 and 24 of the South Worcestershire Development Plan.
Prior to the commencement of the development hereby approved including any demolition, a photographic and written record of the elements of the existing building to be demolished, in accordance with Historic England guidance, shall be submitted to an approved in writing by the local planning authority and once approved shall be deposited with the Worcestershire Historic Environment Records Office. Reason: In accordance with policies SWDP 6 and 24 of the South Worcestershire Development Plan and the Framework regarding heritage assets.
Prior to the commencement of the development hereby approved, detailed measures to be incorporated into the extension to ensure that it does not overheat in summer or require significant energy use to heat in winter, shall be submitted to and approved in writing by the local planning authority. The details so approved shall be implemented as part of the approved development and be retained for its lifetime. Reason: To ensure that the proposed development is sustainable in terms of energy usage and the proposed additional floor-space provides suitable levels of comfort for users of the extension to the Theatres, in accordance with policy SWDP 21 of the South Worcestershire Development Plan.
Prior to the commencement of the development hereby approved, details of measures to be incorporated within the development to achieve the BREEAM “excellent” standard, including rainwater harvesting and re-use within the Theatres complex, shall be submitted to and approved in writing by the Local Planning Authority. The details so approved shall be implemented as part of the approved development and be retained for its lifetime. Reason: To ensure that the water usage is minimised and that the proposed development is sustainable in accordance with policy SWDP 30 of the South Worcestershire Development Plan.
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.

Bats and their 'roost' sites are protected under the 1981 Wildlife and Countryside Act and the Habitat Regulations 1994, the latter of which deems them a European Protected Species. It is a criminal offence to recklessly disturb or destroy a bat 'roost'. Where a bat 'roost' is present a licence might be necessary to carry out the works. Further information about species licensing and legislation can be obtained from the Species Licensing Service on 0117 3728000. If evidence of bats is found during works, work should stop immediately and Natural England must be contacted on 01453 764450 for advice on the best way to proceed.
