The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – [insert all approved plan numbers]. Reason: To define the permission. |
In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11' and where remediation is necessary a remediation scheme must be prepared and approved in writing by the Local Planning Authority in advance of the scheme commencing. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority prior to development commencing other than that required to be carried out as part of an approved scheme of remediation. REASON To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors and to accord with policy SWDP31 of the South Worcestershire Development Plan. |
A Construction Environmental Management Plan shall be submitted to and approved in writing by the Local Planning Authority prior to commencement of development. This shall include the following:- a. Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway; b. Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc); c. The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. The measures set out in the approved Plan shall be carried out in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority. Reason: To protect the amenities of nearby properties during the construction of the development and to protect the natural and water environment from pollution. |
Prior to the commencement of the development hereby approved representatives of Worcestershire County Council, as the Highway Authority and the applicant, shall carry out a joint road survey/inspection on the roads leading to this site. Any highlighted defects shall be rectified to the specification and satisfaction of the Highway Authority before work is commenced on the development hereby approved. A further joint survey/inspection shall be undertaken following completion of development hereby approved and any necessary remedial works shall be completed to the specification and satisfaction of the Highway Authority within 1 month or other agreed timescale. Reason: To protect the long term interests of the Highway network and accord with policy SWDP4 of the South Worcestershire Development Plan. |
No development shall take place (including any demolition, ground works or site clearance) until a construction environmental management plan (CEMP: Biodiversity) has been submitted to an approved in writing by the Local Planning Authority. The CEMP shall include: (a) Risk assessment of potentially damaging construction activities; (b) identification of "biodiversity protection zones" (c) Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction. (d) The location and timing of sensitive works to avoid harm to biodiversity features; (e) The times during construction when specialist ecologists need to be present on site to oversee works; (f) mitigation measures to prevent pollution of the river. The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
A landscape and ecological management plan (LEMP) shall be submitted to and approved in writing by the local planning authority prior to commencement on site. The content of the LEMP shall include the following: (a) Description and evaluate of features to be managed; (b) Ecological trends and constraints on site that might influence management; (c) Aims and objections of management (d) Appropriate management options fo acheiving aims and objectives; (e) Prescriptions of management actions (including an annual work plan capable of being rolled forward over a five year period); (f) Preparation of a work schedule (g) Ongoing monitoring and remedial measures. The LEMP shall include details of the long-term implementation of the plan and how it will be dlivered. The plan shall also set out (where the results from monitoring show that conservation aims and objectives of the LEMP are not being met) how contingencies and/or remedial action will be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. Prior to the commencement of works a further bat survey of the area of willow which was identified as having potential to support roosting bats in the vicinity of the proposed access track. The survey shall be submitted to and approved by the local planning Authority and include whether there have been any changes in presence and/or abundance of roosting bats and idntify any likely new ecological impacts that might arise from the any changes. Where the survey results indicate that changes have occurred that will result in ecological impacts not previously addressed in the approved scheme, these will be addressed within the construction environmental managment plan (CEMP) and/or the landscape environmental management plan and these will be submitted to and approved in writing by the local planning authority. prior to any works commencing on site. Works will then be carried out in accordance with the proposed new approved ecological measures and timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays, Public Holidays or Bank Holidays. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan. |
Before the commencement of construction works on the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Bats and otters and their their breeding sites and resting places are strictly protected by UK and European law. It is a criminal offence to deliberately kill or injure a bat or otter, destroy its breeding or resting place, obstruct an entrance to its breeding or resting place, disturb while in a place of shelter or protection. If evidence of bats or otters is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. It may be necessary to obtain a relevant licence from Natural England. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant. |
