| The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location plan, Amended Block Plan, PEG 005, 005 & 007.
Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDPR 39 of the South Worcestershire Development Plan Review 2026. |
| The development hereby permitted shall be carried out in strict accordance with the mitigation, compensation and enhancement recommendations for protected species set out in the Preliminary Ecological Appraisal and Biodiversity Net Gain Assessment report produced by Aware Ecology dated 28/05/2026 and submitted with this application.
Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policies SWDPR01 and SWDP29 of the South Worcestershire Development Plan Review 2021 - 2041 (2026) and to to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 |
| Prior to the commencement of development hereby approved, a landscape and ecological management plan (LEMP) shall be submitted to and agreed in writing by the Local Planning Authority. The content of the LEMP and shall be guided by the requirement to achieve Biodiversity Net Gain and maintain this after implementation, and, at a minimum, must cover the following:
a. Landscape and ecological aims and objectives of management
b. Description and evaluation of the landscape and ecological features to be managed (both existing and proposed);
c. Ecological trends and constraints on site that might influence management;
d. Appropriate management options for achieving aims and objectives;
e. A maintenance schedule for the first 5-year establishment period, and an annual work plan for on-going management capable of being rolled forward for a minimum of 30 years thereafter;
f. Details (type and location) of any wildlife boxes and hibernacula
g. Details of the body or organisation responsible for implementation of the plan;
h. On-going monitoring and remedial measures.
The plan shall also set out where the results of the monitoring show that both landscape and conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The LEMP will be implemented in accordance with the approved details.
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDPR 28, SWDPR 29, SWDPR30 and SWDPR
34 of the South Worcestershire Development Plan Review 2021 -2041 (2026). |
| Notwithstanding the submitted plans and details, no external lighting, including floodlighting, security lighting, or any other form of artificial external illumination, shall be installed, erected, or operated within the application site unless and until full details of a proposed external lighting scheme have first been submitted to and approved in writing by the Local Planning Authority
Reason: In order to safeguard the character and appearance of the surrounding landscape, in accordance with Policy SWDPR34; and to protect the amenity of nearby residential occupiers from light pollution, glare, and disturbance, in accordance with Policy SWDPR35. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless:
- A Biodiversity Gain Plan has been submitted to the planning authority; and
- The planning authority has approved the plan.
Subject to Paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990, the biodiversity gain plan must include:
a) Information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat;
b) Completed metric tool calculation;
c) The pre-development biodiversity plan and value of the onsite habitat;
d) The post-development biodiversity plan and value of the onsite habitat;
e) Any registered offsite biodiversity gain allocated to the development, including register reference numbers, and the biodiversity value of that gain in relation to the development;
f) Proof of purchase for any biodiversity credits purchased for the development; and
g) Any such other matters as the Secretary of State may by regulations specify.
