Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – BYE/BJP/26/1-1, BYE/BJP/26/1-2, BYE/BJP/26/PROPOSED SITE PLAN, "Location Plan." Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
The holiday let unit/visitor accommodation hereby approved shall not be occupied as a person or persons’ sole, or main place of residence. Reason: The proposed accommodation is only acceptable as a holiday let in accordance with policy SWDPR 46 of the South Worcestershire Development Plan Review 2026.
The owners/operators of the holiday let unit/visitor accommodation hereby approved shall maintain an up-to-date register of the names of all owners/occupiers of the accommodation. This register shall be made available within 1 calendar month of a written request by the Local Planning Authority. Reason: The proposed unit/accommodation is only acceptable as a holiday let in accordance with SWDPR 46 of the South Worcestershire Development Plan Review 2026.
The proposed holiday accommodation hereby approved shall only be used ancillary to the holiday let accommodation known as Southend, and shall not be used for a standalone, single unit holiday accommodation separate from the operation of Southend. Reason: To ensure the local road network can accommodate the type and volume of traffic generated from the development safely in accordance with policy SWDPR 06 of the South Worcestershire Development Plan Review 2026.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDPR 38, SWDPR 39 and SWDPR 40 of the South Worcestershire Development Plan Review.
The development hereby permitted shall be carried out in strict accordance with the recommendations made in respect to protected species set out in paragraph 5.1 of the Preliminary Ecological Assessment report produced by Willder Ecology, dated 26/04/2026 and submitted with this application. Reason- To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with polices SWDPR 29 of the South Worcestershire Development Plan Review, paragraphs 187 and 193 of the National Planning Policy Framework (NPPF).
No external lighting shall be provided other than the maximum of one external LED down-lighter above or beside each external door (and below eaves height) with a Corrected Colour Temperature not exceeding 2700K and brightness under 500 lumens. Every such light shall be directed downwards with a 0 degree tilt angle and 0% upward light ratio and shall be controlled by means of a PIR sensor with a maximum over-run time of 1 minute. The lighting shall be maintained thereafter in accordance with these details. Reason – To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with SWDPR 29 of the South Worcestershire Development Plan Review 2026.
Prior to the first use of the development hereby permitted, bird and bat boxes shall be installed and retained thereafter in accordance with Appendix 5 "Proposed Planting Enhancements Map" as stated within the Preliminary Ecological Assessment submitted within this application, created by Willder Ecology, dated 29/04/2026. Reason- To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDPR29 of the South Worcestershire Development Plan Review, paragraphs 187 and 193 of the National Planning Policy Framework (NPPF).
Prior to their installation, cladding and roofing materials to be used on the holiday accommodation hereby approved, shall be submitted for the approval of the Local Planning Authority. The details shall include a trade description and an image or sample. Details should demonstrate that the materials have been considered in relation to the recommendations of the Welland Neighbourhood Plan (2024). Following the written approval of the Local Planning Authority, the materials shall be installed and retained thereafter in accordance with the approved details. Reason: In the interests of visual and landscape impact in accordance with SWDPR 28 and SWPDR 34 of the South Worcestershire Development Plan Review 2026 and the Welland Neighbourhood Plan 2024.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDPR05, SWDPR28 and SWDPR34, SWDPR 46 of South Worcestershire Development Plan Review 2026.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - considering the imposition of conditions. - seeking further information following receipt of the application; In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
