Condition Details / Information Notes
Malvern Hills District Council, The Council House, Avenue Road, Malvern, Worcestershire WR14 3AF HEREBY CERTIFY that application reference M/26/00671/CLPU registered on 5 May 2026 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice as the matter described in the First Schedule to this Notice would not be lawful as at the 5 May 2026 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s): The proposed development would result in a rear extension which is more than half the width of the original house, based on the footprint of the property as it existed on 1st July 1948. The proposed extension would therefore not comply with the limitations set out under sub-paragraphs (j)(iii) and (ja). As such, the proposed development is not considered ‘permitted development’ as assessed under Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015 (As Amended). The proposed development is therefore not lawful and an application for planning permission is required.
