Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan, Proposed Block Plan 05630-00-B sheet 03, Floor Plan 04, Roof Plan 05 & Elevations 06. Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and the amenities of nearby residential properties in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development hereby permitted shall not be operational outside the following hours of: - 07:00 to 19:00 Monday-Friday - 08:00-13:00 on Saturdays - no operations on Sundays and Bank Holidays Deliveries to, and collections from, the development shall not be made outside the following hours: - 07:00 to 19:00 Monday-Friday - 08:00-13:00 on Saturdays - no deliveries on Sundays and Bank Holidays Reason: To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review 2026.
The premises shall be used for B8 and E(g) use and for no other purpose, including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. The premises shall only be used for ancillary storage in conjunction with Unit 1 and no separate planning unit shall be created. Reason: Alternative uses may not be suitable having regard to potential impacts on highways safety and neighbour amenity, and to accord with Policies SWDPR06 & SWDPR35 of the South Worcestershire Development Plan Review.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDPR 39 of the South Worcestershire Development Plan Review 2026.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason: To preserve the amenities of the locality in accord with Policy SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review 2026.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
