| Schedule 2, Part 3, Class R of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) at paragraph R.(a) outlines that the change of use of a building and any land within its curtilage from a use as an agricultural building to a flexible use falling within one of the provisions of the Use Classes Order set out within (i) to (v) of paragraph R.(a), is permitted development. This application proposes the change of use of buildings to flexible uses falling within more than one of the provisions of the Use Classes Order set out within (i) to (v) of paragraph R.(a). Therefore, the proposed change of use is not permitted development as per Schedule 2, Part 3, Class R of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). |
| Positive and Proactive Statement. In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan and Supplementary Planning Documents and provided the applicant with the opportunity to engage with the Council's pre application advice service. Despite these efforts, the Council still consider that the application should be refused for the reason set out within the decision notice. |
