Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Site Location Plan (Hallow Leas Development) Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
Prior to the removal of the play equipment and fencing hereby approved, a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include a site plan indicating the layout and details of grassed areas, any tree, hedge or shrub planting, provision of benches or other street furniture, as well as a schedule of maintenance. Any planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the removal of the play equipment. Any planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. The development shall be carried out in accordance with the approved details and the site shall remain in use as public open space thereafter. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and remains as public open space in accordance with policies SWDPR07, SWDPR28, SWDPR34 and SWDPR49 of South Worcestershire Development Plan Review 2026, policy HAL4 of the Hallow Neighbourhood Development Plan 2021 and Paragraph 104 of the National Planning Policy Framework.
The planning permission hereby granted does not confer any land ownership rights, and the applicant cannot legally implement the development (removal of the play equipment) without the landowner's consent.

In dealing with this application, the Council has worked with the applicant in the following ways: - providing advice prior to the application submission - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
