| The Development hereby approved shall not be brought into use until the visibility splays shown on drawing WE116-EN-S184-100A have been provided on site. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway.
REASON: In the interests of highway safety, further to policies SWDPR 06 and SWDPR 28 (B vi.). |
| The approved temporary access shall be implemented prior to the commencement of development and retained for the duration of the construction period only. The access shall be constructed in accordance with details to be approved, including its siting, width, surfacing, drainage, visibility splays, and any associated traffic management measures.
Reason: In the interests of highway safety, to ensure the proper construction and reinstatement of the public highway, further to policy SWDPR 06 and SWDPR 28 (B vi.).

| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| The temporary access shall be formed under a licence issued pursuant to Section 184 of the Highways Act 1980 and shall be constructed to the specification and satisfaction of the Local Highway Authority. |
| It should be noted that a possible temporary culvert, within the adjacent ditch, will require Ordinary Watercourse Land Drainage Consent. This consent must be approved prior to any works commencing on site. The consent is obtained from the Engineering Section. Please

| The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while that nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. Any vegetation clearance (i.e. removal of trees, scrub, hedgerows) shall not commence until a careful check for nesting birds has been completed, particularly during the main breeding season (months of March to August). If bird nests are found then works in the area must stop until the chicks have fledged the nest. |
| The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless:
a Biodiversity Gain Plan has been submitted to the planning authority, and
the planning authority has approved the plan.
Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include:
information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat;
the pre-development biodiversity value of the onsite habitat;
the post-development biodiversity value of the onsite habitat;
any registered offsite biodiversity gain allocated to the development and the biodiversity and the biodiversity value of that gain in relation to the development;
any biodiversity credits purchased for the development; and
any such other matters as the Secretary of State may by regulations specify.
