| The proposed development, as a consequence of its substantial scale and unsympathetic design, would result in a disproportionate addition to the host dwelling that fails to harmonise with the dwelling’s traditional form and character, resulting in an proposal which would fail to respect the character of the dwelling or its setting within the Malvern Hills National Landscape. Furthermore, the proposed development would also result in a level of less than substantial level of harm to the dwelling as a Non-Designated Heritage Asset. Any modest economic benefits brought about by construction works would not be outweighed by the harm bought about by the substantial scale and inappropriate design of the proposed development. As such, the proposed development fails to respect the character and setting of the development and would not accord with sections 12 and 16 of the Framework, polices SWDP 6, SWDP21, SWDP23, SWDP24 and SWDP25 of the South Worcestershire Development Plan, policy PL7 of the Malvern Hills National Landscape Management Plan, and the South Worcestershire Design Guide SPD. |

| In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application |
