Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 2540-001 "Location Plan", 2540-002 (B). 2540-003(A), 2540-004(-) Reason: To define the permission.
The Development hereby approved shall not commence until a Construction Environmental Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway; • Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc); • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • Details of any temporary construction accesses and their reinstatement. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
The Development hereby approved shall not be brought into use until the access and parking facilities shown on 2540-002 (B) have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
Prior to its installation, details of the material, colour and finish of the proposed bound surface of the access shall be received and approved by the Local Planning Authority. The approved materials shall be implemented and maintained thereafter in accordance with the approved details. Reason: In the interests of preserving the character of the Malvern Hills National Landscape and wider ladnscape in accordance with Policy SWDP 25.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the ecological enhancements and mitigation specified in the Preliminary Ecological Appraisal carried out by Ros Willder dated 8th December 2025 and submitted with this application. Reason: To ensure the protection and enhancements of local biodiversity and ecology in accordance with policies SWDP 22 of the South Worcestershire Development Plan.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no new windows or other openings, and no additions, extensions or alterations shall be made to the external elevations of the building without the submission and subsequent approval of a separate application for planning permission. Reason: To ensure any subsequent additions, extensions and/or alterations conserve and enhance the appearance of the non-designated heritage asset, mitigate the risk of overdevelopment, ensure any additions remain subservient to the main dwellinghouse in accordance with Policies SWDP 6, SWDP 21, SWDP 23 and SWDP 24 of the South Worcestershire Development Plan and Policies PL5, PL7 and PL8 of the Malvern Hills National Landscape Management Plan 2025-2030: Caring for this Area of Outstanding Natural Beauty.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house shall be constructed on the land forming the curtilage of the proposed dwelling. Reason: To control the size of any outbuildings given their incidental function, distance and separation from the principal dwellinghouse(s) in the interests of visual amenity and to preserve the setting of the non-designated heritage asset and character and appearance of the area in accordance with Policies SWDP 6, SWDP 21, SWDP 23, SWDP 24 and SWDP 25 of the South Worcestershire Development Plan and Paragraphs 131, 189, 190 and 216 of the NPPF.
Prior to any repainting, details of any colour finish to be applied to the exterior elevations of the building including its fenestration shall be submitted to and approved in writing by the Local Planning Authority. These details shall include a specification of the proposed colour. The building shall thereafter be retained in that approved colour scheme. Reason: To ensure any exterior colour finish conserves and enhances the appearance of the non-designated heritage asset and character and appearance of the area in accordance with Policies SWDP 6, SWDP 21, SWDP 24, SWDP 23 and SWDP 25 of the South Worcestershire Development Plan and Policies PL7 and PL8 of the Malvern Hills National Landscape Management Plan 2025-2030: Caring for this Area of Outstanding Natural Beauty and Paragraphs 131, 189, 190 and 216 of the NPPF.
Prior to installation on site, details of all means of enclosure to be erected within the site shall be submitted to and approved in writing by the Local Planning Authority. These details shall include a plan (at a minimum scale of 1:200) detailing the position of all proposed means of enclosure and annotated or accompanied by a schedule specifying the type, height, composition and appearance of the means of enclosure throughout the site. The approved boundary treatment shall be erected before the dwelling is first occupied and thereafter retained in that approved form, notwithstanding the provisions of Schedule 1, Part 2 of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order). Reason: To ensure any means of enclosure conserves and enhances the appearance of the non-designated heritage asset and compliments its rural setting in accordance with Policies SWDP 6, SWDP 21, SWDP23, SWDP 24 and SWDP 25 of the South Worcestershire Development Plan and Paragraph 7.94 of the of the Malvern Hills National Landscape Management Plan 2025-2030: Caring for this Area of Outstanding Natural Beauty and Paragraphs 131, 189, 190 and 216 of the NPPF.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
