Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: Location Plan 2531 E01 Rev B, Proposed Site Plan 2531 P05 Rev B, 25789-25-01 (Topographical Survey) Fence Detail drawing & Landscaping Scheme with written specification outlining cultivation and schedule of maintenance. Reason: To define the permission.
The Development hereby approved shall not be brought into use until the access and track have been provided as shown on drawing titled: Proposed Site Plan 2351 P05 Rev B Reason: To ensure conformity with submitted detail
The landscaping shall be carried out in accordance with the approved drawing Proposed Site Plan 2351 P05 Rev B All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The boundary treatment to be erected shall be as shown on approved drawings Proposed Site Plan 2351 P05 Rev B & Proposed Fence Elevation. All boundary treatments shall be completed before the first use of the development hereby permitted or in accordance with a timetable agreed in writing by the local planning authority. Development shall be carried out in accordance with the approved details and shall thereafter be retained in that form, notwithstanding the provisions of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) Order 2015, as amended, (or any Order revoking and re-enacting that Order with or without modification). Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the mitigation and enhancement measures in The Preliminary Ecological Appraisal report produced by Star Ecology, dated February, 2023, including: -There will be no importing or exporting of soil; -The proposed development will use existing gateway for access and will not require alterations to the existing gateway; -Livestock-proof fencing shall be installed along the southeast and southwest boundaries of the copse to exclude livestock from the copse; -Three woodcrete/woodstone bird boxes and three woodcrete/woodstone bat boxes will be installed on matures trees within the copse. On completion of works, the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm the mitigation and enhancement measures for biodiversity have been successfully implemented in accordance with the details approved under this condition. Reason. To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan, and paragraphs 174, 179 and 180 of the NPPF
Cadent Gas Ltd own and operate the gas infrastructure within the area of your development. Prior to carrying out works, please register on www.linesearchbeforeudig.co.uk to submit details of the planned works for review, ensuring requirements are adhered to. The original holding objection was triggered due to the presence of a High-Pressure Major Accident Hazard Pipeline (MAHP). The minimum building proximity distance (BPD) for the pipelines and associated installations is as follows: • Specific HP 14 m metre BPD metres The building proximity distance taken from The Institution of Gas Engineers and Managers publication IGEM/TD/1 Edition 5 which is the standard applicable to steel pipelines and associated installations for high pressure gas transmission and IGEM/TD/3 Edition 5 Steel and PE pipelines for gas distribution.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
