Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan Culvert Details – Dwg No. DD-ENG-SE-PRVP1-MISC-1430 Proposed Elevation Plan – Dwg No. DD-ENG-SE-PRVP1-MISC-1420 Proposed Site Plan – Dwg No. DD-ENG-SE-MISC-SP-1460 Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the following recommendations: 1. Clearance of any rubble, logs, bricks, other loose materials or other potential refuges will be done by hand during the active season for amphibians and reptiles (March to October) when the weather is warm enough to allow animals to disperse naturally. 2. Grass areas will be kept short prior to and during construction to avoid creating attractive habitats for wildlife. 3. All building materials, rubble, bricks and soil must be stored on raised platform (e.g. wooden pallets) to prevent their use as refuges by wildlife. Any trenches left overnight will be covered or provided with ramps to prevent animals falling into the trenches and being trapped. Excavations left overnight should be checked prior to filling. Any open pipes left overnight will be covered. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while that nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. Any vegetation clearance (i.e. removal of trees, scrub, hedgerows) shall not commence until a careful check for nesting birds has been completed, particularly during the main breeding season (months of March to August). If bird nests are found then works in the area must stop until the chicks have fledged the nest.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
