Condition Details / Information Notes
The proposed car port, as a consequence of its significant height and massing, as well as its position to the front of the host dwelling adjacent to the curtilage boundary with the highway, would result in a visually obtrusive feature which would dominate the façade of the host dwelling and appear incongruous within the surrounding landscape setting. As such, the proposal fails to comply with Section 12 of the Framework which seeks to promote good design, policies SWDP 21 and 25 of the South Worcestershire Development Plan, policies Des 1 and RE 1 of the Hanley Castle Neighbourhood Plan as well as guidance contained within the Design Guide SPD.
The development proposed would visually intrude upon the setting of a scheduled monument to the south of the site and result in a less than substantial level of harm to the setting of a designated heritage asset. As the proposed development would serve a private domestic residence, there are no public benefits to the scheme. As such, the harm identified to the designated heritage asset would not be outweighed by any public benefits to the development proposed. As such, the proposal fails to comply with the policies contained within Section 16 of the Framework and fails to accord with policies SWDP 6 and 24 of the South Worcestershire Development Plan.

In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application
