Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – PB001. Reason: To define the permission.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Environmental Impact Assessment report carried out by Lorna Baggett dated 27/10/2025 and submitted with this application. In particular: - Precautionary working methods for the nearby TPO/M/376 (2006) and Root Protection Area - Any soil that is surfaced as a result of the installation of the tower will be contained and removed from the site. - The tower shall not be disturbed during the bird breeding season, if emergency works are required during this period, a licensed professional should be consulted to recommend a course of action. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with in accordance policies SWDP22 of the South Worcestershire Development Plan;
The development hereby permitted shall be carried out in accordance with the submitted tree protection plan received 03/11/2025 by “Land App.” Reason: To ensure that the proposed development mitigates the impact on nearby trees and roots during its construction and use in accordance with SWDP22 of the South Worcestershire Development Plan.
Between the months of April and the end of June, the House Martin caller shall not be used/ active outside of the timings below: - 06:30-10:00 am - 19:00-21:30pm Reason: To mitigate the impact of noise on nearby residential occupiers to comply with the principles of the relevant criterion of SWDP 21.
The operation of the development hereby approved shall be carried out in accordance with the noise mitigation details within the submitted Sound Management Plan document, submitted 12/01/2025. Reason: In the interests of residential amenity in accordance with Policy SWDP 21.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
