Condition Details / Information Notes
The proposed upward extension under Class AA has been assessed against the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), Schedule 2, Part 1, Class AA. The proposal does not comply with the requirements of Class AA as the applicant has failed to provide sufficient ecological information, such as a preliminary roost assessment, to enable the authority to assess the relevant impacts of the development set out in paragraph AA.3. This information is necessary to assess the potential presence of protected species within the site and surrounding landscape, the likelihood of impact, and the extent of any harm arising from the development. In the absence of this evidence, the authority cannot conclude that the proposal accords with all relevant provisions of Class AA. In particular, paragraph AA.3 sub paragraph (3) of Schedule 2, Part 1 allows the local planning authority to refuse an application where the applicant has not provided sufficient information to assess the impacts of the development.

In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application
