Condition Details / Information Notes
The proposed development by reason of the 4(no.) larger homes would not secure the most efficient and sustainable use of the land in responding to the character of the surrounding area. It would be detrimental to the government’s objective with the need to boost the supply of housing. A high quality design would involve a greater density and support the need for more smaller homes. The proposal is therefore contrary to policies SWDP 2, SWDP 13 and SWDP 21 of the South Worcestershire Development Plan and the National Planning Policy Framework (Dec 2024) and in particular paragraphs 129, 130, 131, 135 and 61.
No mechanism (a section 106 agreement or UU) has been entered into to secure financial contributions to mitigate the impact of the development in terms of highways and to secure the provision of affordable housing and the management and maintenance of public open space. As such the application is contrary to Policies SWDP 2, SWDP 7, SWDP 15 and SWDP 39 of the South Worcestershire Development Plan as well as the guidance contained within the South Worcestershire Developer Contributions SPD (July 2018)
Insufficient highway detail has been submitted to address visibility, Pedestrian Connectivity & Sustainability, and Gradient. As such the proposals would be contrary to policies SWDP 21 B ix and SWDP 4 of the South Worcestershire Development Plan.
Insufficient drainage detail has been provided. An infiltration test must be carried out to confirm the proposed means of surface water disposal and additional detail to consider the impact on the surrounding foul water network and Treatment Works. As such the proposals would be contrary to policy SWDP 29 and SWDP 30 of the South Worcestershire Development Plan.
Insufficient details of biodiversity net gain has been provided for the required offsite provision. The Local Planning Authority would need to know the location of the land, and the size, type and condition of the proposed habitat. If the intention is to use the applicant’s own land, the Local Planning Authority would need to know if it has been registered as a gain site, and s106 legal agreement would be required. As such the proposal would fail to ensure that the biodiversity gain objective is met, contrary to Schedule 7A of the Town and Country Planning Act 1990 and Paragraph 019 of the PPG Guidance on Biodiversity Net Gain.
In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; seeking further information following receipt of the application; as well as considering the imposition of conditions and the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF. Despite these efforts, the Council consider that planning permission should be refused for the reasons set out above.
