Condition Details / Information Notes
The proposal by virtue of its size and siting in relation to the main dwelling is considered to result in a building capable of independent living that would be tantamount to a new dwelling in the open countryside outside of the defined settlement boundary. There are no special circumstances that apply in this case. In view of this the proposal is considered contrary to policy SWDP2 of the South Worcestershire Development Plan and paragraph 84 of the National Planning Policy Framework. In addition, due to its design, siting and materials, the proposed building is not considered to reflect its proposed use or the character of the dwelling or its setting. In view of this the proposal is considered contrary to policy SWDP21 of the South Worcestershire Development Plan and the South Worcestershire Design SPD guidance in relation to annexe buildings All information submitted with the application and consultation responses have been considered when formulating the recommendation and there are no material considerations identified that would outweigh the conflict with the policies of the development plan as identified above and the proposal would not represent sustainable development or accord with the policies of the South Worcestershire Development Plan (February 2016) when read as a whole, the Design Guide SPD and The Framework.

In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application
