Condition Details / Information Notes
The application site is outside of any defined development boundary and the proposed dwelling does not fall within any of the exceptionally permitted forms of residential development in the open countryside contrary to Policy SWDPR 03 and also contrary to the National Planning Policy Framework. The proposed dwelling is therefore unacceptable in principle and contrary to the development plan. The proposed development is also contrary to Policies SWDPR 01 and SWDPR 06 due to its isolated nature resulting in occupants of the dwelling being wholly reliant on private motor vehicles to meet their day to day needs. The proposal would also result in the loss of a rural employment use having a negative impact on the local rural economy, and no justification in the form of a suitable marking exercise has been provided with the application submission. The loss of the employment use is therefore contrary to Policy SWDPR 15 as well as guidance within the NPPF. The proposed change of use of the work element of the live/work unit to create additional living accomodation is unacceptable in principle, contrary to Policies SWDPR 01, SWDPR 03, SWDPR 06 and SWDPR 15 of the South Worcestershire Development Plan Review and the NPPF.
A section 106 legal agreement has not been completed to secure the provision of the necessary affordable housing contribution. As such the proposal is contrary to policy SWDPR 19 of the South Worcestershire Development Plan Review which seeks on sites of less than five dwellings to secure a financial contribution towards local affordable housing provision based on the cost of providing the equivalent in value to 20% of the units as affordable housing. It is also contrary to guidance in paragraph 63 of the National Planning Policy Framework.
The decision to refuse planning permission has been taken having regard to Drawing no/s: - 25-20159-PL3 Location Plan - 25-20159-PL4A Site and Block Plan - 25-20159-PL1A Ground Floor and First Floor Plans as Proposed - 25-20159-PL2 Elevations as Proposed
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
