Condition Details / Information Notes
The development would, by reason of its proposed layout, design, height and appearance, have an adverse impact upon the character and appearance of the area. This harm would be significantly compounded by the size of the proposed gardens, that are considerably larger than that previously permitted under the provisions of Class Q via the extant permission M/24/01635/GPDQ, and would consequently have an urbanising and detrimental effect upon the rural character of the area, resulting in further unwarranted encroachment into the open countryside diminishing its intrinsic character and beauty. Consequently, the development would be contrary to Policies SWDP 2, SWDP 21, SWDP 25 of the South Worcestershire Development Plan and paragraphs 131 and 135 of the NPPF.
No mechanism (a section 106 agreement or UU) has been entered into to secure financial contributions to mitigate the impact of the development in terms of the provision of affordable housing, community infrastructure and the management and maintenance of public open space. As such the application is contrary to Policies SWDP 2, SWDP 5, SWDP 7, SWDP 15 and SWDP 39 of the South Worcestershire Development Plan as well as the guidance contained within the South Worcestershire Developer Contributions SPD (July 2018).
There is insufficient information to address the biodiversity interests that include the Biodiversity Net Gain metric, the need for revised information including a pre-development habitat plan. As such the proposal would be contrary to Policy SWDP 22 and Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021).

In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The applicant was made aware of the concerns with the originally submitted scheme and provided the opportunity to withdraw and consider options, however, the applicant chose not to consider this advice. Despite the Council’s efforts, it is considered that consent can be refused for the reasons set out in the decision notice.
