Condition Details / Information Notes
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – The development hereby permitted shall be carried out in accordance with the following approved plans: Location Plan, PP 1000 Rev C, PP1001 Rev D , PP1101 Rev B & PP 1100 Rev B. Reason: To define the permission.
The trees shall be protected as set out in the report by Jim Unwin entitled BS5837 Tree Constraints, Impact Assessment & Tree Protection Method Statement for new houses Updated 24th April to address Tree & Landscape Officer comments 16th April 2024. Reason: To mitigate the risk of the development causing harm to the health, vitality and amenity of the trees in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development shall be carried out using the materials as specified on Drawing Number PP1100 Revision B. Reason: To ensure that the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development shall be carried out in accordance with the information contained in the Planning Statement and on plan references S046.3E and S047.3E. Reason: To ensure that the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development shall be carried out in accordance with the information contained in the previously submitted Planning Statement for application reference 23/01759/FUL, on drawing no references S046.3E, S047.3E (in as far as the drawings relate to landscaping details) & PP1001 Rev D. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development shall not be occupied until the proposed development has been fitted with electric vehicle charging points. The electric vehicle charging points shall be retained for the lifetime of the development. Reason: In the interests of sustainable development.
The development shall not be occupied until foul and surface water drainage works have been carried out in accordance with the details approved under condition discharge application reference M/24/00845/CCO & updated calculations in document reference 242002-KTN-TN-01-D dated 29th August 2025. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
The development shall be carried out in accordance with the information contained in the Planning Statement submitted with this application for superfast broadband unless otherwise agreed in writing with the local authority. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016.
External lighting shall be installed and used in accordance with the approved details on plan references S046.3E & Drawing Number PP1001 Revision D unless otherwise agreed in writing with the local authority. Reason: To ensure that the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development shall not be occupied until space has been laid out within the site in accordance with Drawing Number PP1001 Rev D for cars to be parked and for vehicles to turn so that they may enter and leave the site in forward gear and that space shall thereafter be kept available at all times for those purposes Reason: In the interest of sustainability.
The visibility splay shown on the Visibility Splays Drawing shall be maintained free of obstruction exceeding 0.6m in height for the lifetime of the development. Reason: In the interests of highway safety
The development shall be carried out in accordance with the conclusions and recommendations set out in the submitted Preliminary Ecological Appraisal prepared by Phillipa Stirling Date: 14/04/2021 Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The renewable and/or low carbon energy generation measures as specified in the Energy Strategy by Fenton Energy Ltd dated 24th April 2024 shall be carried out in accordance with the approved details. Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
