Condition Details / Information Notes
Due to its size, form and design, the proposed dwelling would represent an incongruous addition to the street scene along Yates Hay Road, which would fail to integrate effectively with its surroundings in terms of its form and which would fail to reinforce local distinctiveness. As such, the proposed dwelling would be out of character with the surrounding built environment along Yates Hay Road, to the detriment of the visual amenity of the surrounding area and street scene, contrary to Policy SWDP 21 of the South Worcestershire Development Plan (2016), the South Worcestershire Design Guide Supplementary Planning Document (2018), Chapter 12 of the National Planning Policy Framework, and Policy MD1 of the Malvern Town Neighbourhood Plan (2019).
In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan and Supplementary Planning Documents and provided the applicant with the opportunity to engage with the Council's pre-application advice service, in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however identified substantial issues associated with the proposal and the work required in order to address these issues would go beyond the scope of this planning application. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
