Condition Details / Information Notes
South Worcestershire Development Plan Review Policies SWDPR 02 & SWDPR 03 set out that the development strategy for the adopted plan is to provide for and facilitate the delivery of sufficient housing to meet objectively assessed needs to 2041. The council can demonstrate a deliverable 5 years supply of housing land to meet this identified need. The application site lies within the open countryside as defined by SWDPR 03, where new development is strictly controlled and limited to specific uses none of which apply in this case. The primacy of an up-to-date development plan is enshrined in paragraph 12 of the National Planning Policy Framework. In this case, the proposed development, due to its location outside of the settlement boundaries defined within the South Worcestershire Development Plan, conflicts with the strategy established under Policy SWDPR 03.
The proposed development by reason of its location at the end of a section of ribbon development would exacerbate the linear form of development and have the effect of urbanizing Berrington Road. Furthermore, the loss of hedgerow would exacerbate the adverse visual impact of the development harming the character and appearance of the countryside. The proposal is therefore contrary to Policy SWDPR 34 of the South Worcestershire Development Plan Review 2026 and Para 135 of the NPPF.
Notwithstanding the above reasons for refusal, it is considered that this development is capable of providing the necessary financial contribution towards off-site affordable housing. A secure mechanism is not in place to secure such an obligation, therefore the development is contrary to Policy SWDPR 19 of the South Worcestershire Development Plan Review 2026 and the associated South Worcestershire Affordable Housing SPD and would fail to meet the social objectives of sustainable development as set out in the National Planning Policy Framework
This decision notice relates to the following plan and drawing Nos : Location Plan, 1589 1 B, 2 A, 3 Rev A.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice, seeking further information following receipt of the application and seeking amendments to the proposed development following receipt of the application. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
