Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 2305-01 Site location plan 2305-02 Site block plans 2305-04E Proposed Plans and elevations 2305-05 Typical details Windows Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement and Flood Risk Assessment shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Internal/External Bat Survey 26 New Street report carried out by Dr. Stefan Bodnar BSc (Hons) PhD MCIEEM Bat license, Class License CL18 (Survey level 2) CLS01159, dated 14 July 2025. and submitted with this application. In particular:- - Works should be undertaken outside the peak breeding birds season and bat active season (i.e. outside of March 1st to September 31st), when bats and birds would not be present. If works are undertaken within this higher risk time period, ecological supervision of the stripping of any potential roost features (such as a raised tile) should be undertaken. At the same time a breeding bird check would take place to ensure no breeding birds are impacted by the works and if present, work would be required to cease in the vicinity of any bird nest until fledging. - Two bat boxes and a house sparrow terrace will be installed to compensate for any loss of bird nesting and bat roost potential. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
