Condition Details / Information Notes
Thank you for your notification application of the proposed agricultural development as described above. Based upon the information provided with your application, I write to confirm the Council determine that the proposed development would not constitute Permitted Development. The proposed access track would be sited less than 25 metres from the A438 which is a classified road. As such, the proposed development does not satisfy sub-paragraph h) and therefore cannot be considered ‘permitted development’ under the provisions of Class A of Part 6 to Schedule 2 of The Town and Country Planning (General Permitted Development) Order 2015 (as amended). Therefore, the proposal does not constitute permitted development and would require planning permission.
