Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 20/00301/HP dated 21 April 2020. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 537/001 Rev. A 537/101 Rev. C 537/102 Rev. C Proposed Extension & Alterations to Rose Gables, Eight Oaks, Castlemorton, Malvern, WR13 6BU Date:18/02/2025 Reason: To define the permission.
The colours of external facing and roofing materials to be used in the construction of the extension and alterations hereby permitted shall be as follows. - Vertical timber cladding in Siberian Larch allowed to weather naturally silver-grey; and - 'Dreadnought Staffordshire Blue Sand-faced' tiles in a matt finish. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
The eaves and verge board treatment of the roof extension hereby permitted shall be of traditional timber construction in a dark, recessive colour. The use of boxed-in style, uPVC eaves is not permitted. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
The rooflights hereby approved shall be of recessed, between-the-rafter installation, such that they sit flush with the roof plane. Reason: To ensure that the rooflights are unobtrusive within the roof and represent quality design in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with Policy SWDP 29 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations, subject to the use of conditions. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible. However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts.
