Condition Details / Information Notes
The site occupies a prominent position in the street scene at the junction of Howsell Road and Frederick Road and in a row of high quality Victorian era properties. In contrast, the proposed pair of semi-detached dwellings would, by reason of their external appearance, footprint, two and a half storey height and massing relative to both the site and its neighbours, result in overdevelopment of this constrained plot, fail to integrate effectively with the pattern and character of the surrounding area; appear visually dominant, intrusive and cramped, forming an incongruous feature in the street scene, compounded by presenting a blank gable to Frederick Road. The proposal is therefore contrary to Policy SWDP21 of the South Worcestershire Development Plan, the Design Guide SPD, particularly Sections 4 and 5 and also contrary to Policy MD1 of the Malvern Town Neighbourhood Plan and paragraph 139 of the NPPF.
The proposed development would result in a significant adverse impact on the amenity of the prospective occupants of the new dwellings by reason of lack of suitable private amenity space to meet day-to-day requirements and proximity of the ground floor accommodation to the neighbouring bin storage area, contrary to Policy SWDP21 and SWDP31 of the South Worcestershire Development Plan, the Design Guide SPD, particularly Design Principles 5I and Section 8; and also contrary to Policy MH2 of the Malvern Town Neighbourhood Plan and paragraph 135 of the NPPF.
The proposal does not provide any on-site parking as required by the Worcestershire County Council Streetscape Design Guide, and Department for Transport publications Manual for Streets 1 and 2 and no evidence to support a zero off-street parking scheme has been put forward with the application to justify this. Consequently, it has not been demonstrated that the development would not to lead to on street parking in the vicinity of a road junction impeding the free flow of traffic and unacceptable adverse impacts on highway safety, contrary to Policy SWDP21 of the South Worcestershire Development Plan and also contrary to Policy MD1 of the Malvern Town Neighbourhood Plan and paragraph 116 of the NPPF.
In the absence of a Preliminary Ecological Assessment, the supporting information submitted with the application is deficient and inadequate, failing to demonstrate that the development would not have an adverse impact on protected species contrary to Policy SWDP22 of the South Worcestershire Development Plan and Policy MH2 of the Malvern Town Neighbourhood Plan and paragraph 193 of the NPPF.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
The decision to refuse planning permission has been taken having regard to the following drawings submitted with the application: - D.S.1.A - Location Plan and Block Plan - D.S.4.A - Ground Floor Plan as Proposed - D.S.5.A - First Floor Plan as Proposed - D.S.6.A - Second Floor Plan as Proposed - D.S.7.A - Elevations as Proposed
