Malvern Hills District Council, The Council House, Avenue Road, Malvern, Worcestershire WR14 3AF HEREBY CERTIFY that application reference M/25/00842/CLPU registered on 3rd June 2025 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice as the matter described in the First Schedule to this Notice would not be lawful as at the 3rd June 2025 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- As the site is located within Article 2(3) land, the proposal fails to satisfy the relevant criteria of both Class B and Class E of Part 1, Schedule 2 of the General Permitted Development Order 2015 (as amended). Specifically, criterion (f) of Class B is not met, as development of this nature is not permitted on Article 2(3) land. Similarly, the proposal is contrary to paragraph E.3 of Class E, as the proposed outbuilding is located between a wall forming a side elevation of the dwellinghouse and the boundary of the curtilage, which is not permitted in Article 2(3) land. Furthermore. the proposed extension would partially project from the west side elevation of an existing enlargement to the dwellinghouse. As such, it would be contrary to criterion (ja), specifically subparagraphs (e), (h), and (j), as well as criterion (d), paragraph A.2 of Class A, Part 1, Schedule 2 of the General Permitted Development Order 2015. As such, the matter described in the First Schedule constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended) thus requiring planning permission.
