| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
| The development hereby permitted shall be carried out in strict accordance with all the mitigation, compensation and enhancement recommendation set out in sections 1-5 of the ‘Further Ecological Survey for Dingle Cottage, Berrow Green, Martley’ report produced by Chelmarsh RG, Dave Fulton dated July 16th 2024 unless otherwise approved in writing by the Local Planning Authority or varied by a European Protected Species licence subsequently issued by Natural England. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
| All lighting shall be installed in accordance with the specifications and locations set out in the TamLite lighting report dated 23/09/2024 and shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
| On completion of works, the development shall be inspected by a qualified ecologist and a statement of conformity and a copy of any bat licences and licence monitoring returns as appropriate shall be submitted to the Local Planning Authority to confirm the mitigation and enhancement measures for biodiversity have been successfully implemented in accordance with the details approved under this condition. Reason - To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017). |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while that nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act. Any vegetation clearance or demolition works within main breeding season (months of March to August) shall not commence until a careful check for nesting birds has been completed. If bird nests are found, then works in the area must stop until the chicks have fledged the nest. |
| Any change in the surface of the PROW must be approved by the Highway Authority and any damage to the surface caused by construction must be restored to the original condition or a specification agreed with this department. No additional barriers can be placed across rights of way without written consent from the Highway Authority. This includes gates, stiles, bars, and any other objects. |
