| The resultant development, by reason of its finished floor levels, the addition of a kitchen window in the south west elevation and raised amenity space, relative to pre-existing neighbouring residential properties at Robins Croft, Shalom and Leamore is intrusive, dominant and overbearing; resulting in unacceptable overlooking and significant loss of privacy to the occupiers of those dwellings. Furthermore, for the same reasons, the failure to reduce the site levels to enable the resultant dwelling to sit lower on the plot, as envisaged in the previously scheme allowed on appeal has resulted in an unsatisfactory standard of amenity for future occupants of the new dwelling. Accordingly, the development is contrary to Policy SWDP21 of the South Worcestershire Development Plan, Part 5I of South Worcestershire Design Guide Supplementary Planning Document and paragraph 135 of the NPPF. |
| A raised amenity space has been created in the area that was assigned for parking and turning on the previously approved plans. A lack of sufficient space for 2 vehicles to park and turn within the site to enable them to leave in forward gear would result in vehicles reversing out of the site which would prejudice the safety of other road users resulting in an unacceptable impact upon highway safety contrary to Policies SWDP 4 and Policy SWDP21 of the South Worcestershire Development Plan, and paragraphs 115 and 116 of the NPPF. |
